Speaker 0: Okay. So joining us now, New York governor Kathy Hochul. Welcome to Fox News Sunday. Great to have you. Speaker 1: Thank you, Shannon. Speaker 0: Okay. So let's start here. The the governor referred to this. I mean, your state constitution was amended by the people back in 2014. It it sets restrictions on when and how you can redistrict. This is what congressman Mike Lawler, who obviously could be at danger of losing his seat. Here's what he says about that. Speaker 2: The voters certified this at the ballot box. They wanted an independent redistricting commission. They do not want partisan gerrymandering, and they do not want it done in a mid decade redistricting. The Democrats who oftentimes lecture everybody about upholding democracy should abide by the state constitution. Speaker 0: Even the head of your Democratic state party there in New York says, constitution seems pretty clear. I don't know where someone could reinterpret this as something you can do every two years. So what's the plan? Is it to go around the constitution, get a new amendment? How do you do it? Speaker 1: You know what, Shannon? These times call for fighting fire with fire. We didn't ask for this fight. You know, I'm busy governing the state of New York, focusing on public safety and affordability. But why are we here today? Because Donald Trump looked at the polls for next year, and they realized based on their failed policies, which are hurting New Yorkers and people all across this country, the tariffs did not create jobs. We now have 2,000,000 people more. 2,000,000,000 more on unemployment. We have Medicaid costs that are being taken away from people. There are gonna be millions of people without health care. The cost of everything is going up. I was at a Target yesterday. Parents are worried about back to school shift. So what they saw was, they said, wait a minute. We're gonna lose power because they actually don't like our policies even in purple and red districts because I know what I'm talking about. I used to represent the most Republican district in congress just a few years ago. I know how they feel. Speaker 0: So Speaker 1: so they know they're going to lose next year, so now they're desperate. It's like, okay. Let's look around the country. Let's demand, not ask, but demand Greg Abbott follow like a lapdog, Donald Trump's order to give him five seats. That's why we're here today. Speaker 0: So, governor If Speaker 1: you wanna have a Texas stand down, we'll stand down as well. Speaker 0: You know that Texas, though, legally can do it right now. You can't in New York. So what is the plan? To ignore the state constitution? To amend it? Speaker 1: No. We'll put it to the people. We amend constitutions. We just did it a few years ago. We can put it to the people. But I think the people of this state, after their what they're seeing when there's one party domination in Washington and how our costs are going up, we're losing jobs, and people are suffering, they're going to want us to use every tool in the arsenal to fight back. And that's what I intend to do. Speaker 0: Okay. You know, obviously, that those maps that came about the last time for redistricting were caught up in a lot of court battles there in New York. Here's how National Review summarized it. They said it was three years ago that New York's Democratic legislature drew up a map so brazenly contemptuous of basic rules that govern a district's contiguous that the state's Democrat dominated court of appeals threw it out. The New York Times at the time called those maps comically That's their quote. So your state's highest court at the time, all the judges appointed by Democratic governors, they threw the maps out. So fair to say Democrats have done what they're now accusing Republicans of doing? Speaker 1: No. We followed rules. We do it every ten years. We base it Speaker 0: on census. You didn't follow the rules. Speaker 1: Well, we did follow the rules. Speaker 0: So the court was wrong? Well, we followed Speaker 1: the rules. And I can I wanna call out the hypocrisy of the Republicans who are now whining about the fact that we're doing something in New York? Where was the outrage when Donald Trump told Texas to just go find just go find five seats for him? Come on. People aren't gonna buy this. Speaker 0: Well, it is legal there in Texas, at least the way that they're doing it for now. And there will be court challenges, I'm sure, when they get done with their map if it ever gets voted on. But here's a little bit more of what New York's highest court said in ruling against those maps. They said the legislature created maps in a nontransparent manner controlled exclusively by dominant political party doing exactly what they would have done had the 2014 constitutional reforms never been passed. They said the maps were no good. Speaker 1: Well, we went back and redrew the maps. We followed the process, and here we are. And we didn't intend to do this again until the twenty thirty two elections. But because we're in a different situation altogether, that demands that leaders stand up and say, I'm not gonna let our democracy be eroded away because there's a blatant power grab to maintain power in our nation's capital. This is what I call a legal insurrection. Mhmm. Legal insurrection. Just let the rules stay the way they are. We'll do it the way we always have. But here we have Texas. And now going to other states, J. D. Vance, why aren't you looking out for how to lower a cost like you promised? Instead, he's going like a lapdog around the country to different states saying, oh, can we pick up some here? Can we pick up some here? Because they know they're going to lose next year. That's the only reason they're engaged in this. And, also, it might be a nice distraction from people asking, all of a sudden, this happens when? When they refuse to release the Epstein Epstein files. So I, along with a lot of people in New York, are saying, what's that all about? Is this just another red herring? So no one's buying this. Just Texas, knock it off, we'll knock it off, and let's get back to governing. But you wanna play these games? We're not gonna sit on the sidelines. We're in New York because we fight back. Speaker 0: Okay. You mentioned J. D. Vance, the vice president. So I wanna play a little bit of what he to say about, what he argues that a number of states like yours have done in being more welcoming to people who are in The US illegally and how that translates into then congressional seats. Here's what he said. Speaker 3: So they get rewarded for welcoming illegal aliens into their state, giving them federal benefits, actually asking the taxpayers of states like Ohio to subsidize them. And then those same taxpayers in Ohio and Indiana and elsewhere, they have fewer congressional representatives. That's ridiculously unfair, and the only real way to fight back against it is for us to redistrict in some ways as aggressively as these hard blue states have done. Speaker 0: So there was a point when you served as a county clerk in which there was talk from the governor, Spitzer, at the time about having the driver's license issued to people who are in the country illegally, you said you'd comply with the law, but call the sheriff about getting those folks arrested. You've clearly had an evolution on that issue. So what about the the vice president's point that the more people you have who are counted in your state who may or may not be here legally, it helps you with congressional apportionment, not fair to the other states? Speaker 1: Boy, they're really stretching hard to justify this power grab, aren't they? I mean, my gosh. You know, we don't support open borders, number one. We will help ICE remove the criminals, the worst of the worst, which is what we were told was going to happen. So why is that the pizza guy working for twenty years, hard work every day to feed people in his neighborhood? Why is that the home health care aide who's being rounded up? Why is it the people who are walking into federal courthouses with a ticket that says show up here for your next appointment, and they're being captured as if they're hardened criminals? Give me a break. Give me a break. Stop stop stop finding all these other excuses to do. All you wanna do is keep control of power in Washington because you know it's slipping away, and it's slipping away quickly. Speaker 0: So you've gotten a lot of praise within your party for hosting the folks from Texas, for fighting back. Here is what some of that praise entitled. Entitled. It says battling Donald Trump requires a politics of courage and fight. Governor governor Hochul is once again meeting that moment. That is from Zoran Mondani. He's now a fan of yours. I know you've had differences in the past, but is the feeling mutual? Do you think he's a good choice for New York City? Speaker 1: We still we still have many differences. I don't know how you white whitewash that away. He can agree with me, and many people agree with me. I think it's not just democrats who say, New Yorkers stand up for our rights. We do that. It's what we're hardwired to do. We're fighters. I'm a I'm a mom from Buffalo. Guess I they're not used to taking on a mom from Buffalo, perhaps. But let me tell you this. There's many areas of disagreement, but, also, there's areas of alignment, including affordability. You know, his election touched a nerve, and people said, you know what? We're just not getting ahead. And the Trump Trump policies that were promised to lift people up, reduce costs, not touch Medicaid, make sure the tariffs create jobs, none of that happens. So there's this sense of we need some change now. So my job as governor of the state of New York, I've worked with two already two different mayors. I'll continue with who work with whomever the voters want me to, and I'll make it work. I will make it work out because I'm not gonna go to war with the 8,000,000 residents of New York that I also So so my job is to calm things down. Let's see what the election results are, but people have to recognize what what that candidate for mayor has also touched a nerve, and we need to be responsive to that. So, I'm aligned with with him that we need to start finding ways to make life more affordable for New Yorkers. Speaker 0: Well, having lived there, governor, I agree with you. Speaker 0: Chairman Risch, ranking member Shaheen, distinguished members of the senate foreign relations committee, thank you for the opportunity to appear today. I would also like to thank the senators from both sides of the aisle who met with me over the past several weeks. It is the honor of my lifetime to earn president Trump's nomination to serve in his cabinet as US ambassador to the United Nations. If confirmed, I stand ready to implement president Trump's mandate from the American people to deliver America First peace through strength national security leadership on the world stage. Before I begin, I'd like to personally recognize my family. We all know in public office that we would not have the opportunity to serve were it not for the support of our loved ones. I'd like to begin with my mom, dad, and brother, Melanie, Ken, and Maddie. My dad was here with me today, and my mom and brother are watching closely from Upstate New York. There is no question that I would not be here without their lifetime of unconditional love, support, and encouragement, and for that I am forever grateful. I also want to thank my incredibly supportive husband Matt, who is also here, and of course most importantly our pride and joy, our three year old son Sam, who made his debut in the US Senate. He is comfortable on the house side. It's new in the Senate, so thank you for the warm welcome. Sam is by far our greatest blessing. Of all the titles I have held, congresswoman, chairwoman, representative, or ambassador if confirmed, My most important title will always be mom. I appear before you today as a daughter, sister, wife, mother, congresswoman, a patriotic upstate New Yorker, and a proud American. I believe deeply in the American dream because I've had the opportunity to live it. I was born and raised in Upstate New York, the cradle of the American Revolution. I grew up in a small business family where my parents instilled in me the importance of hard work, ingenuity, and grit. I was blessed to be the first member of my immediate family to have the opportunity to graduate from college. I graduated from Harvard's with Harvard with honors and then worked at the White House in the West Wing on the Domestic Policy Council and in the Chief of Staff's office. After nearly a decade working in public policy in Washington, I returned home to work in my family's small business and decided to run for Congress. In 2014, I was elected to Congress making history as the youngest woman ever elected at the time. In congress, I have fought tirelessly for the hardworking families of New York's 20 First District delivering significant bipartisan results for my constituents. I was elected by my colleagues to serve as the house republican conference chair becoming the highest ranking woman in Congress at the time and the youngest woman of either party to serve in top elected House leadership. And over the last decade, I have served on the House Armed Services Committee, the Intelligence Committee, the House Education and Workforce Committee, and I'm proud to be the longest serving woman on both the Armed Services and Intelligence Committees. On these National Security Committees, I have legislated on a number of critical issues ranging from military readiness, emerging technologies like artificial intelligence, quantum computing, and cyber security to missile defense. I have worked to enhance American intelligence capabilities, strengthen our alliances and partnerships, and deter our adversaries. On the education committee, I have been the leader in combating antisemitism in higher education. My oversight work led to the most viewed testimony in the history of Congress. This hearing with university presidents was heard around the world and viewed billions of times because it exposed the antisemitic rot in colleges and universities and was a watershed moment in American higher education. When discussing this nomination with president Trump, the president shared with me that he sees great promise in the United Nations if it focuses on its founding mission of international peace and security. President Trump has long advocated for peace and no new wars. He delivered the Abraham Accords, the largest step to regional peace in The Middle East in a quarter century. If confirmed, I will work to ensure that our mission to the United Nation serves the interest of the American people and represents president Trump's America first peace through strength foreign policy. As the world faces crisis after crisis with hostages including Americans still held in Hamas' captivity to national security challenges ranging from China, Russia, North Korea, and Iran, it has never been more critical for The United States to lead with strength and moral clarity. This is especially important regarding our most precious ally, Israel, who faced the bloodiest day for the Jewish people since the Holocaust on 10/07/2023. As a member of congress, I also understand deeply that we must be good stewards of US taxpayer dollars. The US is the largest contributor to the yet the UN by far. Our tax dollars should not be complicit in propping up entities that are counter to American interests, anti Semitic, or engaging in fraud, corruption, or terrorism. We must invest in programs to strengthen our national security and deliver results. To increase the efficacy of UN programs, we must drive reform. If confirmed, I will be the first UN ambassador in over two decades to come directly from Congress, and I have deep respect and understanding of the oversight and appropriations role of the legislative branch, and I look forward to using my strong House and Senate relationships to deliver these much needed reforms. We are truly at a critical point in history. The world must be reminded of the key mission of the United Nations and America's role as its formative leader. Following the devastation, carnage, and holocaust of World War two, the world was desperate for peace, stability, human rights and dignity, and world order. As outlined in article one chapter one of the UN Charter, the purpose of the United Nations is to maintain international peace and security, develop friendly relations among nations based on a shared respect for the principle of equal rights, solve international problems, and harmonize the actions of nations in the attainment of common ends. The UN has not lived up to this founding mission, and we must demand better. It is imperative to ensure strong American leadership American leadership at the United Nations. I share president Trump's vision of a UN reformed by strong America First peace through strength and return to this founding mission of promoting peace and security around the world. In closing, I will forever be grateful to my constituents in New York's 20 First District for giving me the opportunity to serve them as their voice at the highest levels of congress. Ten years ago, Upstate and North Country voters took a chance on a young, first time, unknown candidate who very few believed could win. So I just want to thank the hard working families, small businesses, farms, law enforcement officers, military families, veterans, seniors, so many with whom I've had worked so closely to deliver results on behalf of our communities. Thank you especially to my extraordinarily dedicated staff in both the district and in Washington offices for serving tirelessly for the past decade. The potential misconduct pertains to the repeated assignment of Acting Justice Juan Merchan, a Democrat Party donor, to criminal cases related to President Donald J. Trump and his allies. Acting Justice Merchan currently presides over the criminal case against President Trump brought by Manhattan District Attorney Alvin Bragg. Acting Justice Merchan also presided over the criminal trial against the Trump Organization and will be presiding over the criminal trial of Steve Bannon, a senior advisor in President Trump’s White House and a prominent advocate for President Trump.1 The website for the Supreme Court, Criminal Term, New York County does not provide a comprehensive list of every justice and acting justice sitting in the courthouse, but based on the courtroom directory there are at least 24 sitting justices on the court.2 Acting Justice Merchan is not even listed among them, one assumes, because of his status as an acting justice. Section 200.11(c) of the Uniform Rules for New York State Trial Courts requires that criminal actions be assigned to a judge “pursuant to a method of random selection authorized by the Chief Administrator.” If justices were indeed being randomly assigned in the Criminal Term, the probability of two specific criminal cases being assigned to the same justice is quite low, and the probability of three specific criminal cases being assigned to the same justice is infinitesimally small. And yet, we see Acting Justice Merchan on all three cases. This is the same Acting Justice Merchan who, in violation of New York State Code of Judicial Conduct 100.5(h), donated to President Biden’s 2020 campaign, along with the Progressive Turnout Project and its “Stop Republicans” subsidiary.3 It’s also the same Acting Justice whose daughter is a political consultant working for prominent Democrats, whose firm stands to profit greatly if Donald Trump is convicted.4 One cannot help but suspect that the “random selection” at work in the assignment of Acting Justice Merchan, a Democrat Party donor, to these cases involving prominent Republicans, is in fact not random at all. The simple answer to why Acting Justice Merchan has been assigned to these cases would seem to be that whoever made the assignment intentionally selected Acting Justice Merchan to handle them to increase the chance that Donald Trump, the Trump Organization, and Steven Bannon would ultimately be convicted. I request that both the Commission and the Inspector General investigate this anomaly to determine whether the required random selection process was in fact followed in the assignment of these criminal cases to Acting Justice Merchan. If Acting Justice Merchan or any other Justices of the Court are found to have violated these rules, I would hope that the Commission would subject them to the required discipline. And if any non-judicial employees of the Court are involved in such a scheme, I would hope that the Inspector General subject them to the appropriate sanction. Trump Index No.:       452564/2022 Dear Commission Members: I write today to express my serious concerns about the inappropriate bias and judicial intemperance shown by Judge Arthur F. Engoron in New York’s lawsuit against President Donald J. Trump and the Trump Organization. This judge’s bizarre behavior has no place in our judicial system, where Judge Engoron is not honoring the defendant’s rights to due process and a fair trial. These serious concerns are exacerbated by the fact that the defendant is the leading candidate for President of the United States, and it appears the judicial system is being politicized to affect the outcome of the campaign. Simply put, Judge Engoron has displayed a clear judicial bias against the defendant throughout the case, breaking several rules in the New York Code of Judicial Conduct. Last year, Judge Engoron told President Trump’s attorney that the former president is “just a bad guy” who Democrat New York Attorney General Letitia James “should go after as the chief law enforcement officer of the state.”[1] At the start of the trial, Judge Engoron infamously smiled and posed for the cameras.[2] After the defendant won an appellate ruling against Judge Engoron on the appropriate statute of limitations in this case, the judge simply ignored the ruling.[3] Judge Engoron entered summary judgment against the defendant before the trial even began, without witnesses, other evidence, and cross-examination. This, despite the fact there’s disputed material evidence–and there’s no victim of the defendant’s supposed fraud. Indeed, as the trial evidence has made clear, the defendant paid back the sophisticated Wall Street banks, on time, in full, with interest, as agreed.[4] No insurance company paid a penny. And these banks and insurance companies, supposedly defrauded, continue to do business with the defendant. Yet Judge Engoron decreed before trial the defendant somehow committed fraud. Now, the judge is holding a trial–with no jury–to determine how much of Tish James’ requested $250 million in damages–with no victims–he will extract from the defendant. How does this not violate the defendant’s Seventh Amendment right to a jury trial? And Judge Engoron has made it crystal clear he doesn’t care what the defendant or his attorneys have to say. Indeed, Judge Engoron illegally gagged them. Judge Engoron told the defendant: “We are not here to listen to what you have to say.” He told the defendant’s counsel: “I am not here to hear what he has to say, now sit down!” And Judge Engoron even threatened the defendant’s counsel if he filed a routine motion for a directed verdict: “You better not, Chris!” Judge Engoron and his staff are partisan Democrat donors. As recently as 2018, Judge Engoron donated to the Manhattan Democrats[5]–even though Section 100.5 says that judges “shall refrain” from “making a contribution to a political organization.”[6] Section 100.5 also stipulates that a “judge shall prohibit members of the judge’s staff” from contributing more than $500 “in the aggregate during any calendar year to all political campaigns for political office.”[7] Allison Greenfield has served as Judge Engoron's principal law clerk since 2019.[8] In both 2022 and 2023, Greenfield donated in excess of $500 to political campaigns. In 2022 alone, Greenfield donated “$3,335 in political donations to Democrat candidates and causes.”[9] She’s already given more than $1,000 in 2023 to campaigns.[10] When President Trump’s attorneys notified Judge Engoron, Judge Engoron responded by issuing an illegal gag order against President Trump’s legal team.[11] Judge Engoron has gone on to gag and fine President Trump for merely criticizing Judge Engoron’s law clerk, which is core political speech protected by the First Amendment.[12] If anyone in America must have the constitutional right to speak out against the judge, his staff, the witnesses, or the process, it’s a defendant going through a process he believes is politicized and weaponized against him. To gag a defendant is un-American. It’s an illegal prior restraint on the defendant’s First Amendment rights, which even the progressive ACLU felt compelled to acknowledge after another Democrat judge–D.C. Obama U.S. District Judge Tanya Chutkan–illegally gagged President Trump.[13] Indeed, three Democrat-appointed judges on the D.C. Circuit have since stayed Judge Chutkan’s illegal gag order.[14] Judge Engoron put his judgment in serious doubt by issuing a summary judgment citing as evidence of fraud that the Trump Organization said Mar-a-Lago is worth between $426 and $612 million.[15] The Associated Press reported that two top Palm Beach-area real estate agents said that the club’s “sale of a billion dollars or more would be possible.”[16] In fact, Judge Engoron ridiculously found Mar-a-Lago was only worth somewhere between $18 and $27.6 million. Any http://Zillow.com search shows that nearly 20 acres of prime real estate in Palm Beach, touching both the Atlantic Ocean and the intracoastal waterway, is worth exponentially more than $18 and $27.6 million. And Judge Engoron had in his hand the sworn deposition of Palm Beach real estate agent Lawrence Moens, who said the Trump Organization’s valuations were “reasonable and below my estimate for the market value of the property each year.”[17] Moens was asked in his sworn deposition about what sort of buyers would purchase Mar-a-Lago, and Moens responded: “I could dream up anyone from Elon Musk to Bill Gates and everyone in between. Kings, emperors, heads of state. But with net worths in the multiple billions.”[18] The judge wrote: “Obviously this Court cannot consider an ‘expert affidavit’ that is based on unexplained and unsubstantiated ‘dream[s].’”[19] Judge Engoron apparently doesn’t understand that expert opinions aren’t “dreams.” And this is yet another example why Judge Engoron demonstrated bad judgment by keeping this case, instead of sending it to the expert judges in the Commercial Division where it belongs.[20] Judge Engoron’s bizarre and biased behavior is making New York’s judicial system a laughingstock. Former Southern District of New York federal prosecutor Andrew McCarthy, who has at times criticized President Trump, recently stated that he views the “whole New York justice system” as “fraudulent.”[21] Section 100.2(A) states: “A judge shall respect and comply with the law and shall act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.”[22] Judge Engoron has grossly failed to do this. The Commission’s sanctions against Judge Engoron are necessary to bring back credibility to our great state’s legal system. All Americans, including political opponents, must receive due process and equal protection under our U.S. and New York Constitutions. Judge Engoron’s disdain for President Trump and his politics are evident, and the Commission must take corrective action to restore a just process and protect our constitutional rights. Judge Engoron must recuse from this case. This case is so much bigger than President Donald J. Trump. If Judge Engoron can railroad a billionaire New York businessman, a former President of the United States, and the leading presidential candidate, just imagine what he could do to all New Yorkers. Judge Engoron’s lawlessness sends an ominous and illegal warning to New York business owners: If New York judges don’t like your politics, they will destroy your business, the livelihood of your employees, and you personally.
