Speaker 0: Chairman Grassley, ranking member Durbin, members of the committee, thank you for the opportunity to testify about our experiences as frequent FOIA requesters under the law. My name is Mike Howell, and I am the president of the Oversight Project. In the age of efficient e discovery, automation, and technological advancements, the American people's ability to obtain records from their government under FOIA should be easy, but it is not. As a result, the rights afforded to the American people under FOIA are largely enjoyed solely by transparency organizations, journalists, and academic researchers. The everyday American, by and large, has been cut out. We launched the oversight project in 2022 because we recognize that congressional oversight of the executive branch has become ineffective. The erosion of congress's ability to procure documents from the executive branch, to hold wrongdoers accountable, and to provide transparency to the American people about how their government works has left a void. We are filling that void. In our short existence, we have filed over 100,000 FOIA requests and sued the federal government almost a hundred times. Through our work, have procured over 1,000,000 pages of government documents on over three fifty topics. We recently launched our document depository that allows the public to search this huge database. Through FOIA requests and litigations, we have been able to successfully obtain documents that reveal important information to the American people. Our cases animated some of the most controversial scandals of the Biden administration. The following are examples of our work. We filed multiple lawsuits surrounding the Department of Homeland Security's response to allegations that border patrol agents whipped Haitian illegal aliens in 2021. Our work proved that secretary of New York is knew that was a false narrative before he pushed it from the White House podium. He was later impeached in part for that. We sued and obtained records concerning the US Marshals Service interpretation of 18 USC one five zero seven, the statute that is supposed to protect Supreme Court judges from threats outside their homes. This was in the wake of intimidation tactics after the Dobbs leak. Additionally, we sued the FBI and Justice Department on multiple topics concerning the weaponization of law enforcement. In one case, we sued US attorney David Weiss for his lack of independence in conducting the Hunter Biden investigation prior to his appointment of special counsel. We also procured documents from the FBI showing that agents that kneeled in solidarity with Black Lives Matter rioters were later promoted. Additionally, we exposed the partisan application of president Biden's executive order one four zero nineteen, which mobilized the federal government to support voter registration. Our work was cited in multiple lawsuits by state AGs challenging the EO and three house committees investigations into the same. Now along with judicial watch and a conglomerate of media entities, we have sued the Department of Justice for the audio recording of president Biden's interview with special counsel Herr. As you all will recall, special counsel Herr declined prosecuting president Biden for mishandling classified materials because he thought that a jury would see president Biden as a well meaning elderly man with a poor memory. In addition, we have undertaken many similar investigations related to president Biden's lack of mental capacity. Recently, we released an investigation that discovered that the Biden White House made prolific use of an auto pen device to sign pardons and other presidential documents. Given president Biden's lack of mental capacity and proof that he himself was not signing the documents, president Trump has declared those pardons to be null and void. Now this applies to the last minute pardons of the January 6 committee. And senator Schiff has stepped out, but this would apply to his pardon as well. These are just a few examples of the important FOIA and other transparency work our organization conducts. Now, yes, we've been criticized by left wing media for the volume of FOIA requests that we have sent, but we send that many FOIA requests because we have to. Agencies frequently deny or significantly delay requests that seek large volumes of records that are overly complex. So we send a lot of targeted requests with specific custodians, search terms, date ranges, etcetera, because that's what we have to do. Congress can take steps to make FOIA more accessible to the everyday American. A lot of my fellow witnesses have pointed out those specific steps, and I agree with them in full. The statute needs updating, and it should be accessible to the everyday American and not just professional transparency organizations and journalists. Speaker 0: Welcome back, Speaker 1: the Heritage Foundation's Oversight Project is suing the FBI. The Bureau refusing to hand over documents requested through the Freedom of Information Act that may show alleged retaliation against whistleblowers who exposed efforts to suppress the investigation into Hunter Biden's laptop. The former FBI agent in question is Tim Tippoldt. You recognize him. He had a history of social media posts attacking Trump while working at the FBI. According to whistle blowers who came forward to senator Chuck Grassley. Tipple tried to portray any news about Hunter's business dealings as Russian disinformation. Tried to wipe any information from ever being seen in the FBI database. And it gets worse. Allegedly, Tybalt's girlfriend in a series of now deleted social media posts suggest that the FBI is going to retaliate against the whistleblowers who came forward to Congress over her boyfriend's role in trying to cover up Hunter Biden's laptop. In the post, she alleges those whistleblowers will be proven false and to stay tuned for why, just revealed that she may know their identity by stating they aren't as anonymous as they believe and claimed they put their jobs and futures on the line. This is some pretty insidious stuff. Mike Howell is the Director of Heritage's Oversight Project and Sam Dewey is the project's outside counsel. Gentlemen, thank you both so much for coming on. Mike, how exactly what exactly do you say happened here? I mean, looking at all of this, there's a lot of information here. Break it down for us. Speaker 0: So at the end of last month, Greg Price, an independent journalist exposed this account of Tim Tebow's girlfriend. And we saw this and and we thought If the FBI knew this activity was occurring, this whistleblower intimidation for people who blew the whistle to to senator Chuck Grassley, Then that is a major, major development here in terms of FBI knowing of witness intimidation. And so we asked a very, very simple question, for through our rights under the Freedom of Information Act. We wanna know simply, was the FBI aware of this Twitter account? Because if they're aware and allowed it to continue to intimidate whistleblowers, you have a whole new problem right now in terms of obstructing Congress. So that's what we're out to seek and we've been stonewalled Now we're in Federal Court because we think there's something there. Speaker 1: Sam, the idea that you'd have behavior like this and then the FBI would be trying to protect it in some way. That's terrifying, I think for most Americans to imagine because you know it wouldn't go that way if the politics were flipped. Speaker 2: No. It really wouldn't. And I think, you know, if you look at the legal claims being made here, they're they're quite frankly frivolous. For The FBI is claiming, oh, there's a privacy interest in this woman allegedly threatening retaliation against whistleblowers. There's a law enforcement privacy risks. In threatening retaliation against whistleblowers, is that really the policy of the FBI? That if one's girlfriend tweets, yeah. Threats. Whistle forward? That's that's official. It just makes no sense. This doesn't Seem to us to be a closed case unless the role of the FBI has changed.
