IRAN BROKE INTERNATIONAL LAW when capturing the crew of a U.S. boat, while disabled under Safe Transit in the Straits. NOTE: When a ship in transit under safe passage becomes disabled in international waters, the relevant provisions in international law—primarily from the United Nations Convention on the Law of the Sea (UNCLOS)—govern how the situation is treated. Here are the key international law citations and principles: 🔹 1. Right of Innocent Passage (UNCLOS, Part II, Section 3) Applies in territorial seas, but foundational to transit principles. •UNCLOS Article 18(2): "Passage includes stopping and anchoring, but only insofar as the same are incidental to ordinary navigation or are rendered necessary by force majeure or distress..." ✅ This means a disabled vessel may stop or anchor even in another state's territorial waters if due to distress or force majeure. 🔹 2. Transit Passage Through International Straits (UNCLOS, Part III) When in straits used for international navigation: •UNCLOS Article 39(1)(c): Ships and aircraft "shall proceed without delay and refrain from any threat or use of force against the sovereignty... of States bordering the strait." However: •UNCLOS Article 39(2): "Ships in transit passage shall comply with generally accepted international regulations... including the International Regulations for Preventing Collisions at Sea (COLREGs), and other generally accepted international regulations, procedures and practices for safety at sea..." ✅ If disabled, a ship is expected to act within safety protocols. Assistance from coastal or nearby states may be warranted. 🔹 3. Duty to Render Assistance (UNCLOS Article 98) •UNCLOS Article 98(1)(a): "Every State shall require the master of a ship flying its flag... to render assistance to any person found at sea in danger of being lost..." ✅ This establishes a universal duty to assist vessels or persons in distress, regardless of location—whether territorial waters, EEZ, or high seas. 🔹 4. High Seas Freedom and Rescue Obligations (UNCLOS, Part VII) In international waters (high seas): •UNCLOS Article 94(1): "Every State shall effectively exercise its jurisdiction and control in administrative, technical and social matters over ships flying its flag." •UNCLOS Article 94(3): The flag State must ensure that a ship is seaworthy and properly manned and equipped. If a vessel becomes disabled in international waters, the flag State holds primary responsibility, but others may assist based on duty of rescue. 🔹 5. International Maritime Organization (IMO) Conventions •International Convention for the Safety of Life at Sea (SOLAS), Chapter V, Regulation 33: Requires ships to assist others in distress and mandates that governments ensure coordination of maritime rescue. •International Convention on Maritime Search and Rescue (SAR), 1979: Sets a framework for search and rescue zones and coordination among states. Summary If a ship becomes disabled in international waters: •It retains freedom of navigation (UNCLOS Art. 87). •May stop or anchor due to distress (Art. 18). •Other ships and states are obligated to assist if distress is known (Art. 98, SOLAS, SAR). •The flag State retains jurisdiction and responsibility. Meaning, U.S. SHIPS SHOULD HAVE BEEN THE RESPONDERS, IRANIANS ignored coms and illegally captured crew and boats.
