I'm an actor, singer, and all around performer from a magical place called Sydney in Australia. 34 year old Katie Lees loved to joke. She traveled the world as an actress, but came home to work in comedy. Parents, Ian and Penny Lees were her biggest fans. Speaker 2: She just loved the experience of being alive. Her big phrase even as a child and as an adult was fun. Speaker 1: Hi. My name's Katie. I'm a client leader here at Bridgeclimb. Speaker 3: She was fit and healthy. Like, she was, 1 of her jobs that paid the rent was bridge climb leader. So you don't climb up and down the Harbour Bridge several times a day if you're not Speaker 1: fit and healthy. Speaker 1: In June 2021, Pfizer became the preferred vaccine for young adults like Katie, but supplies were low. There was an oversupply of AstraZeneca linked with a rare but fatal blood clotting disorder. Under pressure to speed up the rollout, Scott Morrison announced a major change in the guidelines. Speaker 4: The ATAGI advice, talks about a preference for AstraZeneca to be available and made available to those as preferred for those over 60. But the advice does not preclude persons under 60 from getting the AstraZeneca vaccine. Speaker 2: The consequence of that decision and that announcement, there's a strong connection between Katie's decision making and that announcement. I saw her the morning before she went and got the vaccine, and, like, she said to me she said, dad, I'm just so proud of what I'm doing for the community. Speaker 1: Katie followed the latest advice and had the AstraZeneca vaccine. 10 days later, she was unconscious and in ICU. Speaker 2: I had a call from the senior doctor in ICU, and his opening line was, Katie will not survive this. Speaker 1: After 3 days in ICU, the family made the heart wrenching decision to turn off Katie's life support. Speaker 3: People would, yeah, say to us, but how do you know that the vaccine caused her death? And we'd say it's on it's actually on her death certificate. Speaker 1: Not only were Iain and Penny met with skepticism about the cause of their daughter's death, they were cruelly labeled anti vaxxers for speaking out. Speaker 2: And I always say to people, which bit of people dying or getting disabled from being vaccinated makes you an anti vaxxer? Speaker 3: 1 thing that we've done which has helped all of us is we've tried to turn what's such a horrific thing into a into something that might be a little bit positive.

More importantly, I thank GOD. He has been on my side from the beginning. 5. I self-represented in this case, which took more than a year to finalise. 6. The Court has advised that “There is no written Judgment available unfortunately as the Judicial Officer only delivers oral Judgment for the small claim hearing matters.” - so this Decision will not be available on the NSW Case Law website.

7. “The first conclusion relates to the reasonableness of the department’s vaccination direction. Whilst there is quite rightly no challenge by Ms Ooi to the lawfulness of the COVID vaccination policy, the Court finds that the department acted unreasonably in its application of the policy to her.” 8. “It was unreasonable to direct Ms Ooi to get vaccinated or obtain an exemption and return to the office at that time as she had a valid working from home agreement in place, she was actively investigating Novavax…” 9. “The second conclusion relates to the department’s actions of placing Ms Ooi on leave without pay… There is no lawful basis to place an employee on leave without pay…The actions taken by the department to direct Ms Ooi to cease work and place her on leave without pay amounted to a suspension under s 70 of the GSE Act.” 10.
