Speaker 0: Joining me now to dive into the debate over FISA reauthorization is Jeff Carlson, an investigative journalist. Jeff Carlson, thank you so much for joining us. Good to have you back on the show. Speaker 1: Yeah. Thank you for having me. Speaker 0: Now section seven zero two of FISA is up in the air right now after what happened on the floor house floor yesterday. How did that vote play out? What happened yesterday? Speaker 1: Well, you know, that's a good question because there's a lot of confusion surrounding this. Yesterday was not a vote directly on FISA nor was it a vote directly on having warrants required for surveillance of Americans. What it was was a vote on having that issue come before congress, and it all would have been kind of tied together, FISA as well as the amendments. And, unfortunately, that was voted down. And the reason that I say that it's unfortunate is because, a, we're almost certainly gonna see FISA come back before us, but we're probably gonna see it come back before us without the ability to require a warrant for surveillance of Americans. Yesterday's vote would have allowed congress it would have forced congress, actually, a better way to say it, to vote up or down on whether they agreed that warrants should be required before surveilling Americans. And now that didn't happen, and it's it's highly likely that we're gonna see this come back at us under a different rule set, and we're probably not gonna have that, that warrant requirement attached to it. That that's my guess. Speaker 0: Speaking of warrants, several Democrats and Republicans have been outspoken about section seven zero two of FISA, saying it's been misused or even abused. What are some examples of that misuse? Speaker 1: Well, it's been chronically abused. There there's a number of problems here. First of all, there was a report from the inspector general, Horowitz, the same guy who did the Russia collusion report, the FISA reports. And what he found is that, first of all, there was an immense number of queries, something like 3,400,000 queries of the database in 2021. And of that, approximately one third of them were violating the rules that exist under the FISA database. So in other words, there was either roughly 1,000,000 I mean, think about let that number sink in. 1,000,000 queries that were either illegal and or improperly done. And there's another issue here as well, and it's one that goes way, way back, and that is the accessibility into this database. You know, in theory, people think that it's kind of limited, and you have to go through all these rules and processes procedures to be able to get to this information. That's just not the way it works. There's a minimum of 10,000 people that have access to this database. And, you know, when when back in the day when Mike Rogers was working with the FISA court and they were trying to understand where all the entry points were into the database, they couldn't even find all of them. So it's it's it's a much more structural fundamental problem here. Speaker 0: And what happened after this misuse was discovered? Was anyone held accountable? What happened to them? Speaker 1: Well, first of all, nobody nobody was held accountable. You know? I mean, we it's something we've seen time and time again. Nobody's held accountable. We're told that the problems are fixed, and indeed, we were told exactly that. There was a FISA report that came out in 02/2017 from the FISA court, and it it, you know, disclosed a number of these problems, including the the access points into the system. And we were told that this was addressed, but, again, you have a Horowitz report and examination of the FISA process in 2021, and the problems only got bigger, exponentially so. So, you know, we we have a fundamental problem fundamental problem of improper queries going on at an enormous level, and we have a fundamental problem of far too many access points, too many people and access points that the system isn't even entirely aware of. So there's no way to say that we've either fixed the problems and or have proper oversight of the system. We don't. Speaker 0: On the flip side, section seven zero two of FISA is often touted as an invaluable tool in stopping terrorism, especially after nine eleven. Now what reforms are needed to it, or or is it just ending Faiza? Speaker 1: You know, if you'd asked me this question a few years back, I would have said maybe more reforms, but I don't believe that. I I've come to the point that I believe that there is no possible reform that can structurally fix this type of problem. You know, again, I would point you to the fact that even after reforms and a whole thorough investigation of the the FISA system, the section seven zero two, it's only gotten worse. The violations have increased, and they've increased at an exponential rate. And I I just don't know how you fix it. And, you know, the idea that think about it this way. The intelligence community dug in their heels and wholeheartedly refused to re to accept having warrants for any Americans that were being surveilled. Meanwhile, congress put into the bill a carve out that would require them to be notified if they were being surveilled. So what does that tell you? That tells you that congress believes the system is broken. They want notification if they are being surveilled. They're worried about being surveilled, and they find out about it. It appears that these "popup NGO shell companies" were created to launder money from federal programs directly, becoming the program equivalent of a DAF (which can be used to launder grant money) between a federal program (that's really a government slush fund) and the sea of NGOs swirling around it. It will be very interesting to see how widespread the use of these popup NGO shell companies actually was. And which federal programs they were able to tap into. A very long tweet in an attempt to more clearly sum up. The basic takeaway from my thread below appears to be that once Biden finished getting Ukrainian prosecutor Shokin fired on March 29, 2016, there was a need to focus on finding the proper replacement for Shokin. Despite DC narratives, Shokin appears to have been honest (for Ukraine) and had been making very real headway in Burisma investigation and was also looking into Hunter. Meanwhile, following Shokin's removal, the Burisma investigation was still technically open and Latvian authorities had identified money laundering activities involving Hunter in Feb 2016. The matter needed to be fully contained before it exploded. Poroshenko appointed Sevruk as Shokin's replacement the same day as Shokin's firing - seemingly not entirely sure of the criteria for his replacement. It seems likely that Blue Star (hired by Burisma at Hunter's urging around this same time) was, in part, vetting Sevruk in April 2016 and found him unsuitable for ending all investigations. We know that Buretta, Tramontano and Painter attended an April 6, 2016 meeting w/Sevruk in Kiev, according to Blue Star’s memos. Enter Former Interior Minister Yuriy Lutsenko who was appointed Ukraine’s new prosecutor general on May 12th. The day after Lutsenko was appointed Biden freed up the IMF $1 billion funding to Ukraine. This is disclosed in the readout of the May 13, 2016 call between Biden and Poroshenko. Unknown if Hunter was alerted (by email cc) to this call as he was to the May 27th call (see below) and a later June 15th WH meeting between Biden and Ukrainian Prime Minister Groysman. On May 27, 2016 - another call between Biden and Poroshenko. This was the call where Hunter was cc'd on scheduling email. Why would Hunter need to know of this call...? Three days later, on May 30, 2016, Lutsenko fired Sevruk - who had been demoted to deputy prosecutor general under Lutsenko. Clean slate all around. It was on this same day - May 30, 2016 - that Nellie Ohr, wife of top DOJ official Bruce Ohr sent an email to Bruce Ohr and three other DOJ officials disclosing the existence of the Ukraine Black Box that was supposedly in NABU's (Ukrainian National Anti-Corruption Bureau) possession. At this time, Nellie was working for Glen Simpson's Fusion GPS doing "open-source" opposition research on Trump campaign. Important to note, no one outside of Ukraine knew of Black Box at the time Nellie sent her email. It's also important to note that in January 2016 the FBI began discussions to enter into a memorandum of cooperation with NABU. By Feb 2016, the FBI had a rep onsite at NABU. By June 2016 they had an office. Why would FBI suddenly need to be physically present at NABU? The Black Ledger docs would be made public by NYT on August 14, 2016, taking down Manafort in the process. NABU published the Black Ledger documents on August 18th. This would be followed by a press conference by a Member of the Ukrainian Parliament, Serhiy Leshchenko on August 19th. Recall that Alexandra Chalupa had been working for months on Manafort/Ukraine - and the Trump Campaign. June 15, 2016 - Joe Biden met with Ukrainian Prime Minister Volodymyr Groysman at WH on June 15, 2016, and announced plans to commit an additional $220 million to Ukraine that year. Hunter was cc'd on scheduling email for this event/day. Joe Biden again used a pseudonym email address. June 30, 2016 - NABU and the FBI entered into a memorandum of understanding that allowed for an FBI office onsite at NABU offices. Speculation here: It seems that once Biden had sorted out the prosecutor situation in Ukraine, he needed to make sure his actions stayed quiet. Or relatively so. All the more so because it seems impossible to believe Obama didn't have at least a general idea of what was going on. Likely, the whole coverup was more to protect Obama than to protect Biden. And if that's true, they couldn't afford to have Trump poking around as the new president. Thus, the intensified targeting of the Trump campaign in spring-mid-2016. This also explains the explosion of attacks on Trump once he became president. It further explains why DNC lost its collective mind when Trump started poking around in Ukraine re: Biden. Call to Zelensky, etc. Leading to first impeachment (no conviction). This whole thing would be totally nuts if it wasn't also backed up by facts. Emails. Phone briefs. etc. There's obviously a huge amount of details left out here. A number of us have huge, far more detailed timelines on all this. Many of you already know a lot of these details. Long Post. Biden and his lawyers have always maintained that as soon as classified documents were discovered at Biden’s office at the Penn Biden Center they notified the National Archives. This was simply not true. The Biden White House took actions to secure and conceal the existence of classified documents held by Biden long before they admitted that Joe Biden held any classified documents. It also appears that high-level White House officials actively worked to sort through boxes of documents and took direct action to hide a number of these boxes from the National Archives - and from investigators - many months before they admitted to the possession of classified documents. On March 18, 2021, Annie Tomasini - Assistant to the President, Senior Advisor to the President and Director of Oval Office Operations - suddenly went to the Penn Biden Center to “take inventory” of President Biden’s documents and material - nearly twenty months before the officially acknowledged timeline began. As Jonathan Turley pointed out, Tomasini was “one of the closest aides to Biden and a close friend to Hunter Biden. Nor was Tomasini the only Biden official to visit the Penn Biden Center to examine Biden’s documents. The Oversight Committee alleges that the Biden Camp “omitted months of communications, planning, and coordinating among multiple White House officials” from their timeline of events. These officials included Kathy Chung, Penn Biden Center employees, and President Biden’s personal attorneys who were sent “to retrieve the boxes containing classified materials.” The timeline from the Biden Camp also omitted multiple visits from at least five White House employees, including the previously mentioned Dana Remus and Tomasini - along with Anthony Bernal, Ashley Williams and an unknown staffer. These “visits” took place in May, June and October of 2022 to access and secure what were purportedly personal items of President Biden at Penn Biden Center. More importantly, no one knows where these documents are - or what was actually in them. As House Chairman James Comer notes, “To date, the White House has not disclosed what was in the boxes Ms. Williams retrieved or where they were delivered.” Additionally, on the same day that Biden lawyers alerted the National Archives to the existence of classified documents at the Penn Biden Center, Pat Moore, President Biden’s personal attorney, scheduled a FedEx pickup with Penn Biden Center employees. According to Comer, “a FedEx worker showed up to Penn Biden Center on November 2, 2022, to load the documents and ship them out. In understated fashion, Comer said that he “finds it troublesome that boxes of documents were potentially removed from Penn Biden Center prior to NARA’s arrival and assessment.” In January 2023, President Biden’s personal attorney, Bob Bauer, released a statement that included a timeline of events that inexplicably began on November 2, 2022, with the “unexpected discovery” of Obama-Biden records at the Penn Biden Center. The timeline from Bauer & Biden was incomplete and misleading. It omitted months of communications, planning, and coordinating among the multiple White House officials, Ms. Chung, Penn Biden Center employees, and President Biden’s personal attorneys to retrieve the boxes containing classified materials. Done as Trump is being prosecuted by Biden's DOJ for what are likely lesser offenses.

6) Cybersecurity experts provided evidence to the court that Dominion’s QR system wasn’t secure, was subject to duplication, and that the ability to generate fake QR codes existed.

7) A cybersecurity expert also found that during Georgia’s August 2020 elections, servers at two county election offices he visited “enabled unsafe remote access to the system through a variety of means,” including the use of flash drives.

8) This same expert found that in one of these counties, “server logs were not regularly recording or updated in full and that Dominion’s technical staff maintained control over the logs and made deletions in portions of the logs.”

9) Experts also found significant problems with the testing processes used by Pro V&V. In a case that involved last-minute updates to Dominion software, the court was told that the testing lab “performed only cursory testing of this new software.”

10) A Dominion system experienced a “memory lockup” after scanning only 4,500 ballots during testing in 2019. Dominion determined that a “power cycle” is required after scanning more than 4,000 ballots. It isn’t known if this issue was fixed prior to the 2020 elections.

11) The court also found that the manner in which the Dominion system functions failed to meet the requirements of Georgia election law. As U.S. District Judge Amy Judge Totenberg noted, Dominion’s system “does not produce a voter-verifiable paper ballot." /END
