🚨If I was facing trial for "War Crimes Against Humanity" I would have tried to overhaul the judicial system too.
Israel's Supreme Court has overturned a central element of the government's judicial reform in a judgment that declares an amendment passed in July as invalid.
What did he try to change in the judicial system?
1. Limiting judicial review: Proposed amendments to Basic Laws aimed to restrict the Supreme Court's power to overturn government decisions by raising the bar for judicial intervention. This would make it much harder for the court to declare laws unconstitutional or block government actions due to "unreasonableness."
2. Politicizing judicial appointments: The proposal sought to grant a dominant role in selecting judges to politicians through a committee where they held a majority. This raised concerns about the potential for political bias and interference in judicial independence.
3. Weakening the power of legal advisors: The legislation aimed to limit the authority of legal advisors in government ministries, potentially allowing ministers greater freedom to act without legal scrutiny. This raised concerns about potential for abuse of power and increased risk of illegal or unethical government actions.
4. Overriding judicial decisions: The proposal included mechanisms for the Knesset (parliament) to override Supreme Court decisions with a "supermajority" vote, potentially undermining the court's authority and creating a possible avenue for bypassing judicial rulings.
These proposed changes faced opposition from legal experts, academics, civil society groups, and even some members of Netanyahu's own coalition. Critics argued that the reforms would weaken judicial independence, erode checks and balances in the government, and damage Israel's democratic institutions.
The Supreme Court's recent ruling overturned the amendment that limited judicial review, a major victory for those opposing the broader overhaul package. Look into the international trade and shipping embargo against Israel, which has led to an 85% drop in shipments to that country. Everything now goes through Iraqi territory.
