But definitely have a lot to say about it without any statistics to back it up. I find it offensive that one of the attorneys, talked about an autistic child, but failed to tell you that he represented a youth pastor that raped a child that got off on probation and a coach that raped a child that got off on probation. So it's interesting how we play criminals to our favor, but there's youth pastors and coaches that are raping children to get probation. Just looking through my notes, I took a lot of notes, and I just To say that there are people that are raping multiple children and getting probation, and to say that that's not true is false. To say that these people are spending lifetime sentencing, I pass this out to all of you, twenty six years of research, minimum sentence, two years, three sixty three offenders, zero point nine years in prison. I'll go up to all, twenty five year minimum sentence, three offenders. Shortest is sixteen years, the longest was seventeen years. So to sit here and say these people are spending lifetime amount sentencing in jail is simply not true. This is twenty six years of research. I can go down two year minimum sentence, three year, four. I can go through all of it if you want for the 1,300, sex offenders. I got all my at this point. I can go through all of it. So to sit here and say, these people are receiving lifetime sentences is simply not true. But you know who's getting lifetime sentences? The children that are getting raped. They're getting lifetime sentences of post traumatic stress and depression and suicidal ideation and substance abuse for just being innocent, for just being at the wrong place at the wrong time. They received the Lifetime Sentence. So let's be very clear when we're talking about who receives the Lifetime Sentence, because it's the children that are raped. And then I'm just gonna go ahead and talk about the rest of the facts, and then I'll end it, because I'm just very frustrated that people can sit up here and bring mistruths about a bill and about what's happening in our state. These are the facts, seventy percent, seventy, seventy percent of people who commit sexual assault against our children go straight to probation. Seventy percent. Those are the facts. Those are the hard facts. Seventy percent in probation. To earn your way in prison for raping children in Colorado, you either have to repeatedly, an average of three different times, repeatedly violate your opportunity in the community by violating conditions meant to keep our children safe, safely in the community, or you're one of two. You are either the seventy percent that get probation or you're one of the 30% where the facts that are so damning that the court, the court sent you to prison. No one has spent more than twenty five years in prison for sexually assaulting a child since we enacted the current sentencing structure. We have twenty six years from when this started. And yet seventy three percent have been paroled. The overwhelming majority, seventy three percent have gotten paroled. And in an average of eight years, eight years, and the twenty seven percent that are still there, some of those are there on those crimes, sure, but also on other crimes because the courts gave them three hundred years because their crimes were so egregious or they murdered their victims or committed other crimes of violence, and that is why they're not parole eligible. So if we're gonna sit here and compare apples to oranges, then call that out because we're comparing apples to apples. And we're doing a disservice to the victims of these crimes to compare apples to oranges. I can knock on the doors of a hundred of your constituents in any district in the state and they would be shot. I have asked people in my town halls, did you know that you can rape a child in our state, sexually assault a child, and get probation, and they are not in our state? There is no way. Do you know that you can rape one child, a second child, a third child one time, and receive probation. And those are the facts that are happening in the state. And to say otherwise that that's happening is absolutely false, and it's a disservice to the victims that testified tonight. Absolutely flabbergasted that you get probation for sexual assault of a child in the first place, that you might not spend a day in jail. Remember the outrage in California over the Stanford swimmer? Every one of those a hundred doors would not only be knocked that most get probation for these crimes, they would support prison for these crimes. And I'm sure to say if a ballot initiative comes forward, overwhelmingly, the people of Colorado will vote for this. And not a one would be alarmed at how long any of these offenders have spent in prison if they knew the facts of those cases, not one. It's unconscionable that we do not do better, that we are not on the side with protecting children. Low risk sex offender, there's no such thing. When ninety percent of children don't report when arrest and conviction rates are low And when the studies follow them for three to five years and only count arrests or convictions, of course, they don't get through the funnel twice. Why do we accept any risk when we're talking about raping a child? Does it take me bringing four year olds to fill this room for us to listen to what is happening to these children? To finally put victims' rights over the lifelong sentence of criminals, which we know by their research is not happening. Stop sentencing the kids of Colorado to a lifelong sentence. As part of the coalition agreement, the minister for education has been forced to remove RSE guidelines from the ministry's website. So mad they're suing a Colorado school district after they say it tried to force their 11 year old daughter to share a bed with a biological male during an overnight field trip two years ago. Joe and Serena Whales said that they were told that she'd be sharing a room with three female students, but one of them was actually a transgender. Here with me exclusively are those parents, Serena and Joe Wales, and their attorney Matt Sharp, senior counsel with Alliance Defending Freedom. Serena, I remember when this first happened, I believe we covered it. So how why was your daughter told not to discuss why she was being moved? Speaker 1: Originally, they said that because they wanted to protect the privacy of the other students. And our thoughts are, well, what about the privacy of our daughter? But initially, that's exactly why Speaker 0: she didn't deserve any privacy. Speaker 1: Right. Speaker 0: Well and and to your husband, as a father of a daughter, especially, I I can't frankly imagine my reaction to this. It probably wouldn't have been as genteel as yours going to court. But did you try to make, you know, make it known to the school early on before this lawsuit that this was not this was completely wrong? And what was their initial response? Speaker 2: We didn't talk to the school after this. We we looked at the different options, and we felt like the best course was taking legal action to make a difference. There's several issues going on within the Jefco schools where we didn't feel like we'd be heard. We didn't feel like we'd get anywhere by talking directly to the school or even to the district. We felt like we needed to do something to really take a bigger action. We felt like, know, we're two years into this now, so it's definitely been a grind. Speaker 0: This is Speaker 2: But we like, we made the right choice. Speaker 0: This is just insanity. I just did this whole angle on how the family is under attack by the culture, society, education, woke educators. And, Matt, you know, this case was brought on behalf of four families. What sort of relief are you hoping for? You you looking for just, you know, the school to change policies? Is there damages here? And if so, what are they? Speaker 3: Yeah. We want parental rights protected. We want parents to be informed about bad policies like this, and we want their request to be honored. When they ask schools, don't force our daughter to share a room with a boy. The school needs to honor that. It needs to respect parents. It needs needs to protect girls' privacy. So we wanna see this policy enjoined and ultimately changed. Speaker 0: But is there are there damages that the parents here are claiming because of what the girl was told? Speaker 3: Well, the the real damage is the the violation of the girl's privacy, and not just the Wells' daughter, but in one of the other families, their boy was forced to share a cabin with a girl for an entire week where this girl was assigned to monitor the boys when they were showering, dressing changing. So there is damage to these kids, to their privacy rights, and ultimately, parental rights as well. Mhmm. Speaker 0: This is completely insane. I can't even believe we're doing this segment. Speaker 0: When it came to the curriculum issue, the supreme court said earlier this year that parents must be given essentially a right to opt out of this, and you all should have been given at the very least a right to opt out of this before they ever got Mhmm.
