Speaker 0: The last office hours of this year. Do this. Look, I wanna start by addressing something that has occupied a certain I'll use the word small media firestorm, maybe large media firestorm, on x. And that is a piece of news by a journalist called, I think, James O'Keefe. And he, published a video of an internal town hall, I think from June of 'twenty one that I did at Red Hat. And the firestorm is around a set of topics that are asserting, though the language is more, I'll call it deterministic, but it's asserting that what we did is illegal and we are doing discrimination. So let me just get some context. We, IBM, did pull advertising from X about a month ago. We have actually no position. X can do whatever it wants to do, whatever it wants to do around free speech, promoting of political opinions, I think and really fundamentally believe, is up to X and their management and their ownership. We have no view on it, positive, negative or anything. What we do not want is that our ads on X are next to content that we find objectionable. By the way, we'll do the same for any site, it's not unique to X. And we found our alto coming up next to objectionable material and we weren't satisfied with any answer of how that was going to be managed or controlled. And thereby, we said we're not going to advertise on X anymore. I think that's the right that we aim as a company. We can pick which media we decide. Clearly, the management team and the ownership there took umbrage on that and have been quite clear about that. Mr. O'Keefe looked at this and probably got somebody internal because it's an internal video there. So the assertion is that we are being discriminatory in our hiring practices. So let me talk about this. Do I believe that we should be an inclusive culture? Absolutely. I am not changing our mind on that. Do we believe that we should lean in and make sure that all communities feel welcome? Absolutely. I did reference a 5% plus minus, this by the way is only on executive bonus pool for those who make improvement by 1% on certain underrepresented minorities. Okay. Now, I think that people misconstrue what this means. It is not a target. So if any of you hear that there is a target, you can come to me. We do not want targets. I'm quite clear about that. Why? Let's just look at it. It's a 5% change. That means 95% of exact bonuses are driven by business performance. What drives business performance? Having the best people in the role. So if 95% says, go get the best person, the 5% simply says, to have a diverse slate and try to make sure that you're being inclusive in all that you pick from. So I want to be quite clear about this. We always want the best people because that drives the bulk of our performance, it drives how our employees feel, it drives everything else. That is why 95, 5. Okay. Now, as laws change, as whatever happens, we will always try to comply with the law, but we lean in. Being inclusive is a deep, deep fundamental principle we have had, I think for over 80 years, as I think about the strides IBM has made, we were amongst the first to put women into executive management. I think that is either 1930s, I think, late '30s. We were amongst the first to hire Blacks into positions of management in IBM in the United States. I think that was in the 1940s. We have leaned in on what today is referred to as the LGBTQ, these things, but I'll admit in the 1990s when we started, it was a good 15 years before it became mainstream, it was about same sex couples. We want to be inclusive. We want our employees to feel that they can bring their whole self to work and that is the context. Everything else is a minor tool that helps that context and I want to be clear about that principle and I want to be clear about that. We do not believe we did anything illegal. Now, there is clearly a set of people who are going to make inflammatory statements, which were not things that we said, because they claim we are going to fire people. We said no such thing. We said the pool of the bonus was 5% plus or minus. By the way, the 5% plus or minus is nothing. If we can, by the way, do a little bit more on cash flow, the bonus will be a lot bigger. By the way, not just bonus, but also GDP. If we can do better on revenue growth than what we have committed to The Street, all of these will be much, much bigger. So they have far bigger impacts and I hope that everybody is quite aware of that and is able to put it in that context. Many of those attacks, by the way, are going to be about me the individual. Look, I have a thick skin, I'll go deal with it. Our Board is quite aware of what's going on between the Board, our shareholders, me, we'll go deal with it. I would recommend all of you should not respond. Anything there will just cause more of a response. So I would highly recommend, don't feel this thing. However, the principles I just laid out, if you get asked by friends and family, you can feel free to talk about it in that context. Am I aware that there may be pockets inside IBM, but people take these to be far more stringent form of black and white. I think we should be careful and not make it black and white and not make it stringent. So I also want to be clear about that. All right. Enough on that topic and let's kind of move on because we're having a good year, people. We're having a good year and it is based a lot on the hard work and let's go address some of those questions, some about you and some about our business. 1st question

It is perhaps, perhaps the most contentious topic. The and and to be clear out there, President Trump has been clear that he will veto a national abortion ban. So, he has said that because the Democrats have said that he he will apply a national abortion ban, and that is causing a lot of, sort of in independent voters to actually not vote for Trump because they they think that he will implement a national abortion ban. He has been very clear that he thinks it's a state it's a state's rights issue, and he will beat a national abortion ban. So now, you know, there is no answer to this question that will not offend some number of people. But nonetheless, I will tell you what my opinion is, which will certainly offend some number of people. My opinion is that if a baby can survive outside the womb, it it cannot be aborted. It it cannot. So if if if a baby can survive outside the womb, if it is if it is far enough in gestation to survive outside the womb, at that point, it is not abortion. It is murder. So obviously, now now part of the challenge here is that the education system has terrified, girls and and and you know, girls and women, and relentlessly push the idea that that getting pregnant can be the is is the end of your life. Like your career is dead, you're ostracized from society. And and so when you instill terror in in young girls that getting pregnant is the worst thing that could happen, They they obviously, you know, they believe that, if if they're just just kids. And so that when that is a deep seated belief that that they've been hit within the educational system for a long time, then the idea that that they will not get be able to get an abortion even in extreme circumstances is obviously a terrifying situation. And they will not vote for any candidate who, who who who might, you know, essentially who would stop them from from from from getting, an abortion even in extreme circumstances. So this is the issue that we face. It's this relentless, you know, push in education, terrifying, girls and women that if they get pregnant, their life's over. So, and and the the reality is there's there's nothing greater than having a kid. And so, you know, I I get, you know, more joy in my life for my kids than anything else. And that's that's generally true of all all humans. In fact, if if that that is that is how we evolved. But it is a very natural thing, that you will love your children. So so in fact, having a child is will make you happier than anything else in your life ever.

The potential for abuse is limitless here. The scope of this authority is chilling because the directive specifically states that the decision to use lethal force only needs the Secretary of Defense’s approval. While we're told that funding foreign wars to save democracy is essential, the very people telling us that tale are actively working against us. The narrative, especially since COVID, has been shaped to paint citizens that disagree with or question the government, their processes, and their motives as some sort of threat. Perhaps the most egregious example of this in recent times in America is January 6, 2021. The American people gathered at the capitol to contest the merits of a free and fair election as many have done, including the self proclaimed political elites on both sides, by the way, over the years. Hillary Clinton to this day claims foul play in 2016. While no one defends the actions of some on that day, through numerous releases of footage, it's obvious that Capitol Police opened the gates and let the flow of people enter the Capitol. And with further review of footage, most, if not all of these people, seem to be on a tour of the Capitol politely walking between the ropes in an orderly fashion, something far from what the Democrat media machine pushing the insurrection narrative would have you believe. Why does this story still matter? Well, this day set a precedent for future elections and the people's ability to question them by way of protest, social media, or any way that the First Amendment would allow for. The Democrats and their mouthpiece media outlets have, to this day, maintained the violent insurrection narrative with the undemocratically appointed running candidate Kamala Harris still behaving as though Donald Trump, who called for the protesters to make their voices heard peacefully and patriotically, and the peaceful protesters who did just that, are some sort of domestic terrorists. The record of January 6, 2021 has still not been set straight. There are many question marks about what hand the running government had in amplifying the continuous narrative that January 6th was a violent insurrection. Basically, it was a violent insurrection. We determined that ourselves, don't ask questions, and certainly don't try to claim otherwise. Rewrite the history here. Well, that brings us to the 2024 election. It is no secret that the establishment does not want Trump to win. It's also no secret that they have been painting MAGA supporters, Christians, constitutionalists, free speech advocates, and basically anyone who values freedom as some sort of threat that is about to erupt. The opposite, of course, is true. As conservatives as a whole and even libertarians, if we have to use labels, are not violent people in nature. You would be hard pressed to find a single Trump supporter who has actively voiced wanting to start violence. You will constantly see them issuing disclaimers that they are not calling for violence and they mean it. It's just not what we do. We follow the rules. However, several announcements over the past few weeks show us that the establishment may be preparing for just that. The definition of a false flag according to Merriam Webster is a hostile or harmful action such as an attack that is designed to look like it was perpetrated by someone other than the person or group responsible for it. Keep that in mind as we review our first story for the night. Alex Jones issues terrifying post election prediction. On Thursday's episode of the Alex Jones show, the popular newscaster laid out a chilling warning to America. He forecasted that once Trump becomes president, quote, Black Lives Matter, Antifa, and all these Islamic hordes that are allied with the left will engage in massive civil unrest. Well, the possibility is certainly real, and this scenario becomes even more terrifying when you realize that senator Richard Blumenthal of Connecticut is working on a bill to cripple Trump's ability to respond to civil unrest. Specifically, Blumenthal is introducing legislation to limit unchecked presidential authority under the Insurrection Act ahead of Trump's forecasted victory. What the bill means, if passed, is that Trump will be severely handicapped in the face of wide spread violence and unrest. Blumenthal's legislation is designed to handcuff the president by requiring approval from Congress before the military can be deployed to deal with domestic threats. Adding to the possibility of civil unrest, Bill Gates, the man who seems to always financially profit when disaster happens, said in 2022 that America's, quote, political polarization may bring it all to an end. He predicted that at some point, quote, we're going to have a hung election and a civil war. The trigger to civil unrest could be the election, of course. However, Alex Jones warned that an incident like the one that we saw with George Floyd in 2020 could be exploited again to spark widespread riots. Jones pointed out that while the Democrats accused Trump of planning to use the military on the American people, the government is already making moves to do just that. Let's take a listen. Speaker 1: And we've seen Biden and Kamala and a bunch of globalist generals and their surrogates everywhere saying Trump is planning mass arrest, not just of the globalist, not just of the deep staters, but that Trump is going to use the military on the American people. Now there's been a lot of behind the scenes programming there and also public preparation. Remember earlier this year, senator Blumenthal, who quarterbacks a lot of deep state operations, particularly against us and Trump, he runs the operation against us on record with the CIA and FBI. It's come out in court and Congress. Introduced a bill that's sitting there, and they said so that when he's president-elect in 19 days, that's what the numbers are showing even clearer now, That they will trigger Black Lives Matter, Antifa, and all these Islamic hordes that are allied with the left to engage in massive civil unrest. And that then Congress has a bill introduced, which is totally unconstitutional and is a coup against the executive branch and executive powers out of the federalist system to strip the president of the power to call out the military domestically. And then that's now what Kamala and her surrogates are parroting everywhere, and I have clips of that coming up. Simultaneously, in actual policy through executive orders of Biden, 2 weeks ago, we've talked a lot about this. It hasn't got the attention it needed. DOD directive expands domestic military authority to include lethal force during civil unrest. Here's DOD directive 524001. I'll talk more about that today. So while they're loading the military gun and putting it to American people's head and creating cover stories, the military's gonna have to crush the right wing terrorists that are supposedly hiding under every table or about in every bush and in every closet. They are separately accusing Trump of everything that they are preparing to do. Speaker 0: The document Alex is referencing is, again, DOD directive 524001, which does in fact give the military the ability to use lethal force against American citizens. We've included details as well as Alex Jones' full broadcast in the article, so we encourage everyone to review that. We also now have the original publisher of that article, Sayer Gee, joining us to elaborate on further details that have not yet been revealed, as well as Dennis Kucinich, who is running as an independent in the state of Ohio and is very concerned about this DOD directive and where it may lead us. Seiji and Dennis Kucenich, thank you so much for joining us today. We really appreciate you both being here to discuss this incredibly serious topic. Speaker 2: Great to be great to join you. Speaker 3: Yeah. Thanks for having us. Speaker 0: Thank you so much. Well, Seiya, I first was alerted to this DOD directive through, through a repost of your work, actually. And I know, that there have been some misunderstandings about this military expansion, and and what it actually means. So I'd like to actually start there. Can you can you give us a brief rundown and actually address some of the misunderstandings about this? Speaker 3: Absolutely. In fact, I don't normally report on these matters. However, given that I was targeted by my own government, the so called disinfo dozen campaign, where they identified me and others who expressed a sense about the COVID 19 mandates and questions around COVID origins and vaccine safety as a national security threat, I've been forced into a position where I've had to focus on these topics. And when this directive was reported on on Twitter originally, it was actually being misreported that it basically explicitly allowed for the assassination of US citizens. And in fact, it does the opposite. It explicitly forbids that. But what it does do is it actually takes a radical step of allowing for lethal force against civilians with DOD assistance and in in a unique way because it also opens the door for there to be private entities that are subcontracted to that are now given authority or delegated authority to execute those sorts of actions. And this is a profound concern, of course, for those who are aware of the Posse Comitatus Act, which protects us against using the military to enforce civilian matters. And, of course, everyone having gone through January, 6th is extremely sensitive to those protections being eroded. And there are already loopholes around those protections. For example, the Interaction Act, as well as the National Guard clause, which allows the use of essentially military in domestic affairs. So this directive takes it to a whole nother level by basically pronouncing that protection null and void as far as I can see. Speaker 0: Right. That's how I'm reading it. Dennis, your comments? Speaker 2: Well, you know, you have to, let's go back to the 4th amendment because that's where it starts in our constitutional experience as a republic in America. The 4th amendment says that American citizens must be free of unreasonable search and seizures. And what's happened is that we have seen a series of actions taken, over a period of time that vitiates those, that basic right of Americans. Let's go to the passage of the foreign intelligence surveillance act in 1978. It was supposed to be foreign intelligence. Since then, it's been morphed into permitting the US to gather information on, United States persons. So they we already saw a breach of the 4th amendment there. And then you had 911. And once 911 occurred, president Bush declared a state of emergency. Now most people in the United States are unaware that state of emergency is still in effect. It has been continued through a series of presidents, most recently on September 24th of this year by President Joe Biden. And that state of emergency, has, according to the, to one, analysis, has over a 136 expanded executive powers, which includes being able to detail members of the armed forces to foreign countries without congressional approval, undertake military construction, carry out military construction with NATO funds. This goes on and on. And so you've got we're in a state of emergency, then you had Pfizer, an extension pass in April of this year, which were congress rejected an amendment requiring the government to file the 4th amendment and get a warrant if you're gonna surveil an American. So they could still surveil Americans. And now we've got this, DOD directive. When you take a look at the arc of all of these things, you see a a corrosive attack on the 4th Amendment and many other parts of the Constitution. Speaker 0: Yes. You're absolutely right. Looking at the, some of the, some of the people that were sort of a little bit hesitant to take this very seriously, Saya, I was seeing, You know, the attitude that perhaps the government would never turn this way against their people. And they look at it through that light. But as Dennis just highlighted, when you look at the history of how they've done exactly that, it is it paints a very different perception. And let me tell you, as someone who comes from Australia, where we watched the military going to people's houses in the middle of the night, taking them against their will to camps, people who were not even sick, military walking the streets to quote unquote encourage vaccination, this is, you know, I I I've seen this. I've seen the police shooting at unarmed protesters with rubber bullets. I've seen grandmas tackled to the ground, women choked up against walls, and this was our police who were there to protect and serve bottom line when bad people are given bad orders. I've seen them obey them is what I'm trying to say. Now Well well, you know, Speaker 2: the thing that I I wanna drive this point home. America is still in a state of national emergency, which permits the government then to leapfrog into every area that previously would be inconceivable. For example, right now, the president has the ability according to this national emergency declaration that has continued to seize, shut down, or appropriate broadcast stations to suspend laws concerning the production and transportation of chemical, biological, and and warfare agents. I mean, what are we talking about? You see, most Americans don't understand what's happening here. That's why when Sayer Gee did this analysis of this Department of Defense, directive and the it and the recent iteration of it, we've gotta take this very seriously because our government is showing a disrespect for the basic tenets of a democracy. And and it's it's empowering itself to reach deeply into the lives of of the American people. Speaker 0: Yes. Speaker 2: In ways that are in ways that are are that were previously and and still should be unconstitutional. Speaker 3: Well, I'd like to add to that because, Dennis, you're absolutely pointing out the key issue, which is that this completely undermines our constitutional republic in a number of ways because the First Amendment here is also threatened the freedom of speech and assembly. And as you're pointing out, the this CISA. Right? Which is, and, you know, it's it's basically the DHS's, agency for cybersecurity and infrastructure security. And what they did in 2022 around that time, while we were in the middle of a global lockdown, right, ostensibly due to a, you know, a weaponized particle running amok around the world. So for for safety reasons, they had to shut the world down. Right? We all experienced these lockdowns. And in that context, they redefined national security as including cognitive infrastructure. So dissenting narratives were were then identified as literally domestic threats. And in fact, some of that speech around COVID origins and even, you know, advocacy around the second amendment was redefined as potentially a form of domestic terrorism. So when we look at this directive in that context, it is very concerning because our First Amendment is basically been weaponized against the people. That's just the First Amendment. Right? So if you have protests after this election, for example, from either side, this change will affect all citizens. This is a bipartisan issue. And so we need to be looking at this without just a Twitter firestorm of probably 1,000,000,000 of views and engagements. We have yet to have a single media report on the subject. Then we have the 4th amendment. We just went over that. Protection from unreasonable searches and seizures. This is absolutely been violated. This expanding surveillance powers that will cause warrantless spying and data collection on US citizens. And you have the 5th Amendment, which is due process protection against self incrimination. We're looking at the potential for targeted killings, right, that totally bypass the judicial process, denying citizens their basic rights to due process and right to a fair trial. This is 6th amendment. And, of course, the posse comitatus null and void. This is a massive concern, and I thank you for bringing this to the public's attention. And for Dennis, you having an incredible career of advocating for the people on issues of dire concern like this. Speaker 0: I'm so very grateful to both of you, gentlemen. I just wanted to clarify something, Sayah. You said the use of private contractors. Can you just explain that a little bit better? Speaker 3: So that is one of the more concerning aspects of this, directive revision that hasn't even been discussed. But in the change, it literally gives the government the authority to delegate its power now to assist civilian law enforcement with lethal force to what could be a private entity, which does not have to abide by, you know, the universal code of justice for the military, and they don't have the same oversight. So this essentially means subcontractors could go ahead and take on a role that should only be reserved for the military in times of national emergency, which at this point could be defined as a new invisible particle variant declared by the WHO or the CDC without any real adequate evidence showing that's the case. Speaker 0: It could really be anything. Sorry, Dennis. If I can just chime in there, it could really be anything per the UN pact for the future that was just signed and Biden the Biden Harris admin is fully on board with that. Gutierrez, per the UN emergency platform, could declare, you know, a a state that requires an event that requires this sort of response based on a black swan event, a potential pandemic, a climate event. I mean, it really is anything anything that they say it is. Sorry, Dennis. Speaker 2: Go on. Well, you know, to add on to what Sayer is saying and to to bring it into focus, posse comitatus was created specifically to keep the military out of local law enforcement. It actually is, is the one law which provides for democratic policing, And that happens at a local level. So instead of this country empowering more local law enforcement, local law enforcement must be familiar with the constitutional rights of people. The, you know, the idea that people have to be told what their rights are in an encounter with the policeman, Miranda rights. We know that local law enforcement has better capabilities here, but what's happening? There and again, let's look at the arc of things here. Since 911, you had the creation of Homeland Security. Anyone who is, who remembers before Homeland Security, we had some freedom of travel. We don't have the same thing now. We even have Homeland Security surveilling, former members of Congress like Chelsea Gabbard. Transportation Security is part of that. And then you have the FBI and the CIA exchanging information with the military now. So we've America is moving in a direction that is profoundly anti democratic. And this is why Congress must absolutely must look at what's being done to undermine the constitution. Congressman Jordan's committee that looked at the weaponization of the justice system was an important start. But what we have going on here is an attempt to just rip up the constitution, take away our basic rights, and move the military into a dominant position in in the in our local lives here. That was never supposed to happen ever. And so this, Sarah, thanks to you for your, commitment to the basic rights of American people to show exactly what's going on here. And, you know, one final thing, when the Patriot Act was brought before the Congress, I voted against it because I read it. Because I saw how it was was it an axe to the basic constitutional rights of Americans. And even then that process, they switched an original bill out that they had about 10 hours of hearings, and substituted it with a massive invasion of America's, American's private lives, which stands today. Speaker 0: I'm very grateful to you both. I wanna talk about some of the application of this and some potential scenarios very carefully, mind you. We have what I'm what I read this as when I read between the lines is essentially setting up for a future martial law situation. And we have multiple things that have happened over the past few months that are concerning when considering that potential situation. So we have, Congress preparing for a mass casualty event. We also have people like Jamie Raskin saying that if Donald Trump wins, they're not gonna certify and they're gonna create civil war conditions. So we have a very real potential for, a a a setup of a violent situation, which is not instigated by, say, Trump supporters, but could easily be painted as such. I mean, just look at January 6th being painted as an insurrection when it was nothing of the sort, sayer. So where do you see all of these things tying in? Speaker 3: Well, it's very concerning because the way that the official narrative has consolidated around January 6th is that it was a treason treasonous conflict between state and citizens. And, ultimately, what this new directive does is, as Daniel McAdams stated with Ron Paul on the Liberty Report, I mean, this is not a law. Okay? It's a DOD directive. It's part of the administrative state as he describes it. And there's no process to actually involve the the US citizens and our elected officials at this point. So calling for a congressional inquiry, at the very least, would make absolute sense right at this moment. We also have a Tennessee representative, Monte Fritz, who has spoken up on this and actually gave me permission to share this quote. He says, it is a troubling time when our National Guard is deployed to the Middle East by federal authority in support of a 25 year undeclared war for which no clear objective is defined. Then that federal authority wishes to deploy federal troops into the states with an authorization to surveil and kill our citizen, citizen, citizens. Something seems darkly unconstitutional about this. So we do have leaders standing up. They are identifying this as a crisis moment for the United States. This election is so contested as far as the outcome. It hasn't even happened yet. And either side is not gonna benefit from us moving into an official military martial law state, and that is actually what I think this directive does. I will also add that it opens up the door for a DOD component to include AI systems as well as drones. So this is the type of technology that has been activated now to normalize militarization of our public square and our public experience. Speaker 0: So the contractors could very well be the contracted drones, Saya. I mean, we're I think sometimes when people imagine all of the ways in which this could be weaponized, it's unconscionable to them. It's unthinkable that this could ever happen, but yet we've seen examples of this already, drones being used against civilians overseas. And so this is not, this is not somewhere off in the far distant future. And you made such a good point there where you said it's bad for either side. And I wanna talk to Dennis about that briefly because Kamala Harris recently has been making statements repeatedly that Donald Trump wants to utilize the military against American citizens when the Biden Harris admin has literally just brought in this expansion of military powers? It's, again, a classic case of projection. Speaker 2: I would agree with you. And what we're looking at here remember, president Biden has continued a state of emergency. National emergency. And and that's the, camel's nose under the tent of the constitution. Where all of a sudden, we're looking at with this DOD directive that Sayer is so importantly cited. We're looking at the potential of the military being more involved in civilian life of our nation, which posse common taught us specifically for bids. Joseph Nunn of the Brennan Center, pointed out some reforms that have to be made of of, posse, common taught us with respect to, reforming the Insurrection Act, which gives the president broad authority to call troops, that that has to be limited to also do something about the National Guard exemption. Right now, as you pointed out, the National Guard could be mobilized and it is mobilized to go abroad. And it's taken the controls taken out of the governors and where National Guard should be involved in natural disasters and helping to protect people like they, you know, we want them to do after hurricanes and tornadoes and fires. Instead, if they're abroad, that limits their potential here. And then, you also have the military cooperation with law enforcement act, which permits the military to insist in civilian law enforcement. And I think that the primacy has to be on civilian law enforcement, not the military. And so what Joseph Nunn has done is come up with some sensible proposals that congress ought to act on. And and and to wrap this up, it's congress that has to step forward. Now we have a constitution where congress is supposed to be a co equal branch of government. As a matter of fact, it's first among equals because it's article 1 of the constitution. Article 2 is executive branch. What we've had here is a is a is a condition where the executive branch and through a national security state has seized more and more power undercutting the constitutional protections and even run doing an end run around Congress on article 1 section 8 of the constitution, which is the war powers. I mean, think about it right now. We've spent a and $75,000,000,000 in a war in Ukraine and there's been no declaration by Congress. They just anti up the money. We're in a war in the Middle East, the same thing. Congress has to step in here and because, otherwise, the whole basis for the constitution, which is representative government in the con in in terms of Congress has has been undermined. And when that happens, anything goes. When that happens, it's a direct path to martial law. Speaker 0: Absolutely agree with you. Saya, before I go back to you, Dennis, I just wanna focus on the fact you're running currently as an independent in Ohio. Talk to us a little bit about that race because I'm hearing everything that you're saying, and I'm thinking we need more representatives just like you. Speaker 2: Well, you you know, the the Democratic Party, unfortunately, went all in for war. Those who in the party who, objected to it were were slapped down. And so, you know, I'm I'm opposed to war except to defend the country, but we're not on defense here. We're on offense all over the world. Since 9 11, America has spent $8,000,000,000,000 on wars that we didn't have to be involved in. $8,000,000,000,000 out of a $36,000,000,000,000 debt. I'm running as an independent because I I can be a counterbalance to this madness that's going on in Washington. Help people on both sides of the aisle be empowered to look at a different approach, which is to take America out of these endless wars, stop spending the money and adding to the deficit, regain our social regain our basic civil liberties, protect the constitution, and to start to focus on taking care of things here at home. So I'm running as an independent to give people an actual choice. There is a chance I could win. And as Sayer pointed out, if I do, I could very well be the only independent, the next house, 217 Democrats, 217 Republicans, 1 independent myself. And I'll bring those right not just to the table, I'll bring it into legislation. I'll challenge the administration, as far as its efforts to take this country in a direction which is, not democratic. And, you know, while I'm willing to work with whoever the American people choose as the next president, I'm I'm also very much aware of the constitutional responsibilities of Congress to ask questions, to challenge the administration if they're taking a path that is against the, the very nature of our republic. Speaker 3: Well, I just wanna emphasize that for me, Dennis is one of the solutions that we really need to support right now. I mean, to understand this man's legacy, he attempted to establish a Department of Peace in 2,001. So, I mean, he's been so ahead of the curve. He's been a huge advocate of ending the forever wars, of standing up against the very powers we speak of right now throughout his career. So I just wanna affirm that for me, anyone listening, please look into his candidacy. You could be a deciding vote in a split house. And so, ultimately, we're raising awareness around an already dwindling, protection against a military state. The posse comatatus has already had enough loopholes around it that this is really an opportunity for America to take a close look at whether or not we're going to go the route of continuing to see our fundamental rights be completely quashed, as well as, you know, supporting these endless wars that none of us voted for and yet we're paying for. And so ultimately, I feel like it's a great opportunity. I appreciate you bringing this to people's attention, and I encourage everyone to do more research and then act accordingly. Events like Brexit, Trump’s victory, the Arab Spring, and France’s Yellow Vest movement, organized via social media, convinced elites that “information disorders” represented an existential threat to their power. A consensus thus emerged: digital platforms needed to be regulated to curb the rise of populism. This led Macron to launch a legislative onslaught. Under Macron’s presidency, France: — mandated that platforms implement "misinformation detection”; — gave platforms a 24-hour window to remove “hateful” content, and required platforms to remove “deepfakes”; — launched VIGINUM, a counter-disinformation agency created in July 2021, which likely played a role in the contentious cancellation of the first round of Romania’s 2024 presidential election. This pattern of activity suggests a concerted effort by Macron and his allies to police global speech and elections.

10. “—we were planning to confidentially disclose some information sought by the NGOs to them in exchange for them dropping the suit” The NGOs would not settle, despite Twitter’s efforts to cooperate. And so Twitter caved, offering to censor its platform — for all users — in exchange for an end to the lawfare. “An update on the French hate speech matter: back in January we thought we were nearing a settlement,” wrote Twitter’s Associate Director of Litigation, Regulatory, and Competition on February 23, 2021,”[W]e were planning to confidentially disclose some information sought by the NGOs to them in exchange for them dropping the suit. After some weeks (and, apparently, in-fighting among the plaintiffs), they came back to us with a counter-offer that was ultimately unacceptable.” What made the counter-offer unacceptable, she explained, is that “they have refused to make any firm commitment to drop their lawsuit.” In other words, even with access to Twitter’s data, the NGOs wanted to continue their suit. Why? The answer appears to be to create public pressure for greater platform censorship. And Twitter execs knew it. “We anticipate negative press on the ‘failure’ of the mediation, and comms has prepared a reactive statement,” the litigation director wrote. “It is likely the NGOs will try to paint us as failing to cooperate/negotiate in good faith and that we don’t care about/intentionally profit from hate speech. While I believe these characterizations are false and made in bad faith, these are the common themes we have heard from the NGOs throughout the mediation.”

11. “We should be cognisant of the precedent we are setting here which could trigger more asks of this nature into the future.” Twitter also agreed to send a letter from CEO Jack Dorsey to the NGOs, promising stronger action in the future. The “plaintiffs in the UEJF hate speech case are now suggesting that they would be willing to settle the case so long as we provide them with a letter from Jack indicating that he is aware of the case and that the company is committed to fighting hate speech,” wrote Twitter attorney Karen Colangelo on March 9, 2021. “If we can really get the case to go away by just providing this letter, litigation recommends we provide it.” “I think Jack will be supportive,” responded Twitter Acting General Counsel, Sean Edgett, a few hours later. Twitter’s head of public policy responded, “We're supportive of this move and will work with our comms colleagues on the inevitable press cycle that will follow if this letter is leaked. We should also be cognisant of the precedent we are setting here which could trigger more asks of this nature into the future.”

12. “Notably, the lawsuit was very strategically timed…” On March 10, 2021, Colangelo wrote up a brief for Edgett to share with Dorsey on why they wanted the letter. “The lawsuit is one part of a larger effort in France to paint Twitter as a bad actor. Notably, the lawsuit was very strategically timed to begin ‘testing’ of our response rate the day after we announced that our response times would be impacted by COVID-19, many of the ‘hateful’ Tweets included in the 88% we did not remove are not actually illegal under French law or actionable under our TOS, and the suit was publicly announced to coincide with the introduction of the Avia hate speech bill which, according to its author, was motivated by Twitter’s refusal to remove hate speech.” Then, on March 23, Colangelo told her colleagues that the NGOs had “changed their minds” about the letter from Jack Dorsey and “decided that it was insufficient.” The good news, she said, was that “the mediators (who have the ear of the judge) are frustrated with the NGOs and believe they acted in bad faith.” On July 6, 2021, Twitter’s French attorney announced that the Court had dismissed NGOs claims based on lack of standing but ordered Twitter to give the NGOs “any documents relating to the resources dedicated to fighting hate speech… the number, location, nationality and language of the persons assigned to moderation…the number of reports from users of the French platform of its services, concerning apology for crimes against humanity and incitement to racial hatred” and related information. On August 16, 2021, a Twitter executive in Ireland emailed Deputy General Counsel Jim Baker, former General Counsel of the FBI, to say that “the French Constitutional Court handed down its decision on Friday on the new French law that places requirements on Twitter to take a number of significant steps in respect to how we treat content moderation in France. The bill will be enacted by the President in the next few days and enforceable immediately.”

13. Macron Attempts to Circumvent French Law The apparent coordination between the NGOs, the hate speech bill, and Macron’s attempt to contact Dorsey could easily be seen as attempts to circumvent the law. Under French law, the state is barred from imposing preemptive censorship — a practice referred to internally at Twitter as “proactive monitoring.” The government has attempted to bypass the law by using state-funded NGOs as enforcers, acting public pressure and strategic litigation to coerce platforms into moderation practices that exceed their legal obligations. Under Macron, the state is determined to undermine the international “country-of-origin” standard, which holds that digital content must comply with the laws of the country where it is produced, not where it is consumed.

14. Miss France's attorney demands censorship: "What would have happened if Twitter was around in 1942?  Would they have allowed Hitler to speak?" The NGOs cited displeasure with how Twitter was handling alleged online harassment of Miss France. "Despite Plaintiffs' initial insistence that they were done with the mediation, for the first time, Plaintiffs have expressed that they may be willing to drop their case if we give them some information about our moderation practices." On February 23, 2021, Twitter attorney Colangelo wrote to her colleagues, “Note that there was a hearing today on the request from Miss France, April Benayoum, for us to disclose information about various accounts that were allegedly making anti-semitic comments about her.” Benayoum had sued Twitter for failing to act quickly.  “Plaintiffs have expressed they may be willing to drop their case if we give them some information about our moderation practices,” wrote Colangelo to her colleagues in January. But, as with the NGOs, her main goal appeared to be negative publicity — and the acquisition of internal Twitter Data. “Ms. Benayoum's attorney made a number of emotional arguments that might get press attention,” wrote Colangelo, “including talking about the Holocaust, WWII, Adolf Hitler, etc. -- one question he posed to the court is ‘What would have happened if Twitter was around in 1942?  Would they have allowed Hitler to speak?’” Benayoum’s lawsuit demanded extensive internal data from Twitter, including dates and times of Tweet and account removal, and details about Twitter’s process for removing tweets proactively. While the court on April 13, 2021, dismissed most of her claims and acknowledged that Twitter France had no operational control over moderation, which was managed by Twitter International in Ireland, they still ordered disclosures of data relating to reports made to French authorities. The case concluded in a confidential settlement, demonstrating once again how legal action can pressure platforms into concessions. On June 7, 2022, Twitter settled with Miss France.

15. “Twitter's moderation… can undermine public order and the proper functioning of our society.” French courts in 2022 prosecuted then-Twitter France CEO, Damien Viel for alleged “non compliance with a judicial injunction” and “complicity to libel.” The issue? A unit of the Ministry of Interior posted a picture of a high-ranking civil servant inspecting policemen tasked with enforcing Covid lockdowns, and replies from Twitter users compared the French Police to those of Philippe Petain’s Nazi-collaborationist regime. Twitter users dubbed the high-ranking civil servant a “Nazi,” and called for “hanging him at the Liberation.” The litigation appears to have been part of the pressure campaign to expand Twitter’s transparency and hate speech obligations in France. The Versailles prosecutor launched an investigation for libel of a public official and delivered an injunction to Twitter for user ID information. But Twitter France’s CEO did not have access to any user data, which were stored by Twitter International Corporation in Ireland. After the Versailles prosecutor decided Twitter had not responded quickly enough, he charged Viel on the grounds of  “the total failure of Twitter's moderation, which has become a completely asocial network that can undermine public order and the proper functioning of our society.”

16. “How likely do you think a raid is on the Twitter France office?” It was a show trial that failed to persuade the judge. “Damien was just perfect,” wrote Twitter’s French attorney in a July 9, 2021 email to Twitter executives about the hearing. “The police officer was very courteous and hardly convinced by the usefulness of his mission and by the instructions he received.” Still, Twitter’s French lawyer warned, “the prosecutor could increase the pressure on Twitter France by ordering a raid on the company's Paris premises. I don't know what he could find there. However, the risk does exist and we would need to discuss it.” “How likely do you think a raid is on the Twitter France office?” asked the Associate Director of Litigation, Regulatory, and Competition. “It is quite impossible to assess how important the risk of a raid is,” the lawyer answered. I can only say that it does exist and the Prosecutor has such power within the frame of a criminal investigation.” The case ended with Viel and Twitter France being cleared of all charges in March 2022.

17. France is now going after Elon Musk’s X In July 2025, a Paris prosecutor launched a criminal investigation into Elon Musk’s X and its management for alleged interference with an IT system, fraudulent data extraction, and foreign interference. These are significant cybercrime offenses that carry penalties under the criminal code, including up to ten years in prison and a fine of €300,000. Why is France prosecuting X? The answer appears to be that it wants to force X into compliance with French government-approved narratives. The courts have also targeted Marine Le Pen, France’s leading opposition figure. A court found her guilty of embezzling EU funds — for political campaigning purposes — and sentenced her to four years in prison. The punishment includes a five-year ban on holding public office. The court ordered this penalty to take place before Le Pen can appeal, which prevents her from competing in the presidential race, in which she is the frontrunner. For identical charges, the current Prime Minister was acquitted.

18. The US Must Resist Global Censorship The TWITTER FILES - FRANCE reveals a previously unknown aspect of the rise of the Censorship Industrial Complex, which is that nation’s role in pioneering government censorship-by-NGO proxy, which was at the heart of the US Department of Homeland Security’s censorship efforts. The active involvement of Macron underscores the high importance the government put on influencing social media platforms to create, control, and censor narratives. And Macron’s apparent coordination with NGOs and members of Parliament on a Twitter pressure campaign reveals a high level of thought, calculation, and strategy, similar to the “influence operations” and censorship advocacy that Intelligence Community-adjacent NGOs carried out in the US and other nations. The Trump administration has said it is committed to free speech diplomacy and may be pursuing that with Europe. The TWITTER FILES - FRANCE dramatically illustrates the importance of protecting the First Amendment, and why US companies should operate under it, and not a lower standard of free speech.
