Speaker 0: Here with me now, just back from Guantanamo Bay, is Homeland Security Secretary, Christy Noem. Thank you for being here. It's nice Speaker 1: to Speaker 0: to see you in person. So you and the president have said repeatedly that the Speaker 1: worst of the worst will Speaker 0: be held at Guantanamo. There are a few dozen people there already. I I believe they're right now being held in cells formerly used to house terror suspects. So can you give more specifics about who's there right now, what crimes have they committed, and how long you're going to detain them? Speaker 1: So there are several planes, that have transported individuals to the base, and they are in the system and the facilities that, you know, a lot of our worst terrorist criminals have been incarcerated for many years. These individuals are the worst of the worst that we pulled off of our streets. Speaker 0: So Were they? Speaker 1: Murderers, rapists. So when I was there, I was able to watch one of the flights landing and then unload about 15 different of these criminals. Those were mainly child pedophiles, those that were out there trafficking children, trafficking drugs, and were pulled off of our streets and put at this facility. So I'm very thankful that they are off the streets of The United States and that we have safer communities. Speaker 0: And how long will they be there? Are they gonna be Speaker 1: They'll be there until we work with arrangements to take them back to their countries where they belong and have consequences out with them there. So, they will be treated much like, many other individuals in this country that are those dangerous criminals that don't belong here. Speaker 0: Do they have legal Speaker 1: they have due process. Everybody has due process, and every individual has the right for that. And my job is to make sure we're following the law in every single individual that we're bringing into custody and transporting back to their home country. Speaker 0: Since they're there now, they already gotten access to legal counsel? Speaker 1: Yeah. They followed all the same process they would with anybody else that has come in through these systems that any administration has done it. Every step is being followed and due diligence being done even with these individuals that are so dangerous. Speaker 0: You're building tents for a lot more than how many are there now? Speaker 1: Well, they're putting up tents that will have the capacity to go up to 30,000 people. That's not stood up yet because a lot of our soldiers, that's got there received orders just days ago. I think they've been putting up facilities for the last five days. So they've got a lot to do yet, but they have the capacity to start taking individuals. Speaker 0: So when I saw those tents, first thing and I saw the pictures of you in the tent, the cots. Right. First thing I thought is, how are the worst of the worst as you and the president describe it gonna be in those tents? How was that even safe? Speaker 1: Well, we're following all the same standards and procedures that we've always had with our detention centers, whether they're in The United States and now to be utilized here at Guantanamo Bay. So, those facilities, I think we need to be really transparent about and make sure that people know what they're like, and we're going to be encouraging people to continuously. If you're in this country illegally, you should go home. You should go back to your home country. Don't wait until we have the opportunity to sweep you up because you have overstayed your orders, you have final removal orders, or you've been committing crimes in our communities. I've reported extensively on illegal immigration stories, particularly in Massachusetts, where local jurisdictions often ignore ICE detainer requests for serious crimes like child rape. Recently, a Guatemalan charged with multiple counts of aggravated child rape was released on bail without ICE being notified. This pattern continues, as seen in a summer operation on Nantucket where four illegal aliens charged with sexual offenses were arrested after being released into the community. ICE officials express frustration with sanctuary policies that complicate their efforts to ensure public safety.

@BillMelugin_ - Bill Melugin

I’ve covered a lot of illegal immigration related stories around the country in recent years. Massachusetts is the only state that frequently releases illegal aliens charged w/ aggravated child rape & refuses to cooperate w/ ICE on detainer requests for them. Even in other sanctuary states & cities, I almost never see a lack of cooperation for child rape. In this case, a Guatemalan charged with 3x forcible child rape & 3x aggravated child rape was released on bail by Essex County, MA, with ICE Boston saying their detainer request was ignored & they were not notified of his release. During one of my embeds with ICE Boston last year, they arrested four illegal aliens charged w/ child rape in a single morning. All of them had been released by local jurisdictions with ICE detainers ignored. I asked a MA law enforcement source how this keeps happening there? And how does someone charged with so many counts of forcible & aggravated child rape even get bail in the first place? “Welcome to the Commonwealth of Massachusetts,” is the response I got.

Video Transcript AI Summary
It's unbelievable that some jurisdictions refuse to cooperate with ICE, even in cases of heinous crimes like child rape. In Massachusetts, ICE recently arrested a Guatemalan man charged with multiple counts of aggravated and forcible child rape. ICE states that their detainer request was ignored due to sanctuary policies, and the suspect was released on bail without notifying ICE. ICE Boston also arrested a Turkish man charged with assault and witness intimidation, but their detainer was ignored by Somerville, another sanctuary city. Across the U.S., ICE Seattle arrested a Salvadoran man wanted for homicide, and ICE Los Angeles apprehended a Guatemalan man charged with sexual assault and rape. In Colorado, the DEA announced arrests of illegal immigrants involved in serious crimes like kidnapping, child sexual assault, and fentanyl trafficking.

Speaker 0: Well, Dana, it's hard to believe there are any jurisdictions out there that wouldn't cooperate with ICE when it comes to illegal aliens charged with forcibly raping children, but in Massachusetts, it's just routine. Take a look at this case. Ice Boston just announcing they arrested this Guatemalan illegal alien charged in Massachusetts with three counts of aggravated child rape and three counts of forcible rape of a child. So the question is, why was he on the streets? Right? Well, Ice says their detainer request on him was ignored by the Essex County Superior Court due to sanctuary policy. The locals released him into the community on bail without any notice to ICE. In a statement, the director of ICE Boston says in part, quote, Jose Fernando Perez has been charged with some horrific crimes against a minor in our commonwealth. He is exactly the type of alien we are targeting with our worst first policy. He posed a significant danger to the children of Massachusetts, and we will not tolerate such a threat to our community. ICE Boston also announcing the arrest of this Turkish illegal alien charged in Massachusetts with a sultan battery against an intellectually disabled person and witness intimidation. But ICE says their detainer on him was also ignored by the sanctuary city of Somerville. He had also been released into the public. Elsewhere around The US, ICE Seattle arrested this Salvadoran illegal alien wanted in his home country for aggravated homicide. Here in Los Angeles, ICE arrested this Guatemalan illegal alien charged with sexual assault and rape with a gun. And in Colorado, the DEA announced their top 10 arrests of illegal immigrants in recent days, including several affiliated with Trendy Aragua and others with egregious crimes like kidnapping, child sexual assault, and fentanyl trafficking. And Dana, I was talking to a law enforcement source in Massachusetts about the child rape case that I referenced, and I asked, like, there's gotta be some sort of a catch here. Right? Forget about cooperating with ICE. How does somebody charged with so many counts of aggravated, forcible child rape even get released on bail in the first place? The response I got was quote, welcome to the Commonwealth of Massachusetts. We'll send it back to you. And well, they're finally on their way out. Thanks, Bill.

EXCLUSIVE: We embedded with a team of elite Boston based ICE deportation officers as they arrested four alleged child rapists & a violent MS-13 gang member in a single morning. ICE says their detainer requests on all of these illegal aliens weren’t honored by local jurisdictions due to sanctuary policies in Massachusetts. ICE tells me those policies allow illegal aliens charged or convicted with heinous crimes to roam the streets after release without any notice, and make their job more dangerous because they have to find & arrest aliens charged or convicted with aggravated felonies on the streets, instead of having them handed over in a safe environment like a jail. @EROBoston Field Office Director Todd Lyons calls the sanctuary policies “frustrating”, but says arresting multiple alleged child rapists and a violent gang member in one morning is a testament to his team. “That’s every day up here in Boston,” Lyons told me. “Those are the public safety threats we really want to get off the street. It was a great day, great day for the team. Five public safety threats that can’t victimize anyone anymore.” But Lyons added, ICE Boston can only do so much, given current staffing levels. “I don’t have enough officers or resources to tackle all these public safety threats,” he said. “Are we gonna go after the child rapist today, or are we gonna go after the twice deported fentanyl dealer? Because we can’t do both.”

We're in Boston, where an ICE team is targeting illegal aliens charged with egregious crimes, specifically aggravated felonies. Our first takedown was an illegal alien from Guatemala, charged with aggravated child rape. Next, we arrested a Colombian national charged with raping a child over 14. We don't have the resources to get every public safety threat off the streets, but we have to prioritize. Another arrest was an MS-13 gang member from El Salvador. Then we arrested a Brazilian man charged with five counts of aggravated rape of a child. How are we not notified about these child rapists being released? Our final target was a Brazilian gang member, also charged with child rape. Today we got four accused child rapists and one MS-13 gang member. With sanctuary policies in place, local authorities often ignore our detainer requests. These suspects will remain in federal custody until their local charges are resolved, then we'll seek to deport them.

Speaker 0: ICE quickly takes down its first target, an illegal alien from Guatemala charged with aggravated child rape. Minutes later, ICE arrests a Colombian national charged with the rape of a child above age 14. Speaker 1: I don't have enough officers or resources to tackle every one of these public safety threats. Are we going after the child rapists today, or are we gonna go after that two times deported fentanyl dealer? Because we can't get both. Officers then arrested this Brazilian man charged with five counts of aggravated rape of a child. How are you guys not notified about a child rapist being released? Speaker 1: Unfortunately, in Massachusetts, that's how it is with mostly sanctuary jurisdictions. Speaker 0: A short time later, ICE took down their final target, a Brazilian gang member also charged with child rape. Just this morning today, four accused child rapists and one MS 13 gang member. Those are the kind of people you're going after. Speaker 1: That that's every day up here in in Boston. Those are the public safety threats that we really wanna get off the street. Speaker 0: It was Speaker 1: a great day for the teams. That's five public safety threats that are on in the community. Gonna go ahead and victimize anyone else. Speaker 0: And I says all of those arrests you just saw happen because local authorities ignored their detainer request to keep these guys in custody due to sanctuary policies. Local law enforcement cannot hold someone solely on a federal immigration detainer. According to one sheriff, detainers have tripled in the last three years, exceeding 100 in 2024, which he believes means more people illegally in the commonwealth are committing crimes. He cited nine child rapists in Massachusetts jails. ICE arrested one man charged with three counts of rape of a child who posted $7,500 bail. Another ICE arrestee, charged with aggravated rape of a child, was released on $7,500 bail with GPS monitoring. A third man, charged with indecent assault and battery and assault to rape, was released without bail but with GPS monitoring. A criminal defense and immigration attorney says bail is to assure reappearance in court, not to ensure custody. Immigration status is not a bail criteria. Prosecutors can request a dangerousness hearing, but detention until trial is rare. One sheriff supports a bill allowing him to hold inmates wanted by ICE for 36 hours and asking judges to consider immigration status when setting bail. He believes immigration status is a big factor in whether people return to court.

Speaker 0: Local law enforcement have no authority to arrest and hold an individual solely on the basis of a federal civil immigration detainer. They meet their bail, they could be gone within an hour. Speaker 1: Yep. Speaker 0: So you could see how it would be very challenging for ICE to get here in time. Speaker 1: Very. As a matter of fact, it's very frustrating for me to know I might have a drug trafficker or a violent offender getting bailed out of here. I call ICE and they're like, well, we're we're busy with a couple situations. We can't get there for a few hours. I can't hold them right now. Speaker 0: You are seeing more individuals, right, with detainers placed on them? Speaker 1: Yes. Speaker 0: What do you think is going on? Speaker 1: Well, I think what we've seen, and I think it's pretty clear by the data, is that we've seen the detainers triple in the last three years. We were in the thirties a couple years ago. We exceeded a hundred in 2024. To me, that means there are more people illegally in the commonwealth committing crimes. Nine child rapists that were in jail in Massachusetts. Speaker 0: So sheriffs can't hold someone who's been bailed out of their jail. The next logical question is, is there a standard bail set for people charged with child rape in Massachusetts? We went back into those ICE press releases to find out. Take this man, arrested by ICE in February. He was charged with three counts of rape of a child by force in 2022. He posted his $7,500 bail at Essex Superior Court and was released on a condition of staying in his residence. Or this ICE arrestee charged with aggravated rape of a child. He was released from Lawrence District Court on $7,500 bail with a GPS monitoring device. Finally, this man, he was charged with indecent assault and battery on a person over 14 and assault to rape. He was released without bail but with a GPS monitoring device. All of these cases are ongoing, and none of these men have been convicted. Does that seem like an appropriate bail amount? Speaker 1: Well, it doesn't to me. Speaker 0: Steven Roth, a criminal defense and immigration attorney, says these bails are set by judges to reasonably assure someone reappears in court, not to ensure someone remains in custody. Speaker 2: There's a list of criteria that they go through. Immigration status is not one of those of those categories. Speaker 0: Prosecutors may also request a dangerousness hearing to keep a defendant behind bars. But attorney Jennifer Roman says detention all the way until trial is rare. Their primary focus is to ensure the safety of the public while minimizing the restraints or constraints on the defendant. We know these two men had dangerousness hearings and were in jail for a period before they were released from court with This man, only 19 years old, did not have a hearing. Speaker 2: When I ran for office, I promised I would cooperate with all the officials that Speaker 1: could help keep my community safe. Speaker 0: Sheriff Evangelitis now supports a bill filed by two Republican lawmakers, which allows him to hold inmates wanted by ICE for an additional thirty six hours. It also asks judges to take immigration status into consideration when setting bail. Speaker 1: I think immigration status is a big factor in whether people are gonna voluntarily come back to court.

This comes after criminal complaints say last May that Juan Rocca Mahaya paid $250 for sexual access to that minor. The girl allegedly fought off her attacker and fled to a near home where a Good Samaritan called 911. Antonio's sentencing is scheduled for August 21.

I can’t believe this is real. Massachusetts Governor Maura Healey allowed an illegal migrant pedophile, who had been deported, to return and live near a playground. The state was aware of this situation, as confirmed by the ICE Chief, who stated that the individual was living across from a playground and was a known registered sex offender on the Massachusetts probation rolls.

I can’t believe this is real Democrat Governor of Massachusetts Maura Healey let an illegal migrant pedophile who was deported, come back into America and live right across the street from a playground The state KNEW ABOUT IT, confirmed by ICE CHIEF ICE Chief “The person we arrested that was living across the street from a playground. So you have a deported sex offender that the state knew about living across the street from a playground” “They're already known registered sex offenders on the Massachusetts probation rolls”

Massachusetts is not a sanctuary state, but Boston is a sanctuary city. According to Speaker 1, the state is operating like a sanctuary state. Law enforcement agencies and state agencies have reached out to the governor's office to turn individuals wanted for murder in El Salvador over to ICE. Speaker 1 questions why previously deported individuals, including registered sex offenders already on Massachusetts probation, are not turned over. Speaker 1 cites the example of a deported sex offender living across the street from a playground that the state knew about.

Speaker 0: When you talk to the governor, the governor talks about what's going on in her state. She says Massachusetts is not a sanctuary state, but Boston's a sanctuary city. Do you think that the state is operating like a sanctuary state at this point? Speaker 1: 100%. And that's one of the frustrating things for us. And what I'd say for the governor's office is we've had individual law enforcement agencies and state agencies reach out and say, hey. We wanna turn this individual over to you. They're wanted for murder in El Salvador. So how is and or like the sex offenders you saw today, there are already known registered sex offenders on the Massachusetts probation rolls. Why would you not turn someone over that's been previously deported? To me, that just makes no sense. And, again, like the person we arrested that was living across the street from a playground. So you have a deported sex offender that the state knew about living across the street from a playground.
