Evan, what exactly did Durham find in this report? Speaker 1: Well, Jake, the, the bottom line finding from, John Durham's 4 year investigation is that the FBI Moved very quickly to investigate these allegations of connections, of collusion between the Trump campaign and Russia, And that they did so by ignoring a lot of evidence that would have led them to drop that altogether. He's saying that, they may have had reason to open a preliminary investigation, an assessment. Perhaps these are very, very low level investigations. But certainly what he finds is that there wasn't enough there, to to, to to support the FBI's decision to open a full blown investigation of this, of of the Trump Russia ties back in 2016. It's a GAO report or maybe no, it's a Senate report that just came out, in July, just last month, talks about multiple emails going to Steve D'Antwonio on Sunday, Monday and some probably Tuesday, just the days before, talking about the violence that they're predicting coming up to the capital. I their assistant chief, Jeff Carroll. Thank god I had talked to him at 10:59 in the morning and asked him if he could possibly put some additional resource on Constitution Avenue, and he had some CDU, platoons up there. Called him and said, hey. Please send those in right away because we knew as soon as they they came to their west front and they started attacking, it was gonna be bad. 12/58, I make my 1st call to the sergeant in arms asking, saying, hey, it's bad. We need assistance. I need a declaration of emergency. I need to bring in the military immediately and federal resources. I'm told by Paul Irving quote, I'm gonna run up the chain. I'll get back to you. Speaker 1: The chain is Pelosi. Speaker 0: The chain is his chain would be up to Nancy Pelosi. He didn't have to do that, but he wouldn't give me authorization. And the initial explanation was, well, none, and you're insane if you think that you're Alex Jones, you're crazy. And then over the last couple of years, we've seen people confirm, people in authority confirm actually, yeah, there were a lot in the crowd that day. I mean, that's now a fact. Did you know that going in? Speaker 1: No. They Speaker 0: were no. So just for perspective, since you've been to a lot of these events, there's a huge a planned demonstration in Washington, D. C. Will there always be assets, agents, people working for federal agencies in the crowd and civilian close? Speaker 1: There always could be. And for like inaugurations, There would usually be some combined teams out there, one for communications but just for situational awareness. So It wouldn't be surprising, 4th July, different things like that where you have threat pictures or concerning threat pictures. Speaker 0: And what does that look like? Does that mean, FBI agents dressed in dockers and tennis shoes trying to Speaker 1: Well, just be plain clothes, plain clothes to blend in. So that wouldn't be unusual and it'd be, you know, just standard police work. That'd be a good police work. And Jill Sanborn's testimony in 2021 where she said they were taking over action To keep certain people from coming to January 6th to to watch DC. That's that's big for c for FBI to start taking overt action. I mean, that's not covert, over. That's a big that's a big deal. Fast forward to February of this year 2023 and the GAO report that says, on January 4 January 3rd, the FBI was tracking 4 domestic terrorists that we're talking about coming to Washington DC, the Washington field office, their AOR, area of responsibility. By January 6, they were tracking 18 or 19 in the GAO report. Domestic terrorists. So think about that. They have 18 or 19 domestic terrorists coming to this event, So of course, they're going to have resources on them. And then you're not going to be just putting 1 agent, you're going to have multiples. So it would be multiple with that. And I don't know how many they actually had in there. So That would be regular standard police works. I would be surprised by it. But not to share that in the intelligence? That's concerning. They have access to critical information about policies that are being considered and implemented. They can participate in an internal decision making. They can provide or deny knowledge and expertise that those, at the top of the bureaucratic totem pole, need. It ultimately comes down to individual decisions and personal choice. Deciding what to do or what not to do is a very personal decision. It's based on context. It's based on your rank, on your tolerance for risk, on your preparation and frankly where you sit in the federal, federal bureaucracy. We're talking about the range of different tactics. We talk about acts of commission and acts of omission. And another act of commission, albeit Highly, you know, risky, and there are a number of, great downsides is leaking. So leaking information about pending or actual policies with journalists, with activists, influential people on the outside. So another act of, Of commission is creating parallel structures or self organizing units. So organizing in the office place, in the workplace. She testified that she understood her legal duty under the Jenks act to produce the US attorney's office written statements relating to the subject matter of her testimony. Miller acknowledged that among those statements were messages to be sent in the FBI's link messaging system where bureau employees communicate with one another. She testified that in order to comply with her Jinx obligations, he compiled her links messages in an Excel spreadsheet, which was then produced to the USAO. The version of Miller's Excel sheet produced to the defense contained 25 rows of her linked messages. In cross examination, the agent acknowledged she compiled that disclosure. She testified that those messages constituted a complete production of her Jinx statements from links. However, a close examination of the agent's sheet revealed over 1,000 hidden Excel rows of messages. Further on into the documents reveal an agent's request to special agent Miller to go into a CHS informant report that Miller just put together and edit out the agent was present. We know there was some number of undercover federal agents in the crowd at the Capitol. Officials have since admitted that under oath. But what exactly were they doing there? The January 6th committee worked hard are to hide the answer to that question. We do know from contemporaneous video tape that a mysterious figure called Ray Epps encouraged the crowd should go into the capital. For some reason, Epps has never been indicted for that, but there's no question he didn't. We need to go into the capital. Were at all. Under public pressure, the January 6th committee finally interviewed Ray Epps. Epps told the committee that he never entered the capital and therefore never committed a crime. His text messages showed that at 2:12 PM, he boasted to his nephew view that he had, quote, orchestrated the protests at the Capitol. He admitted he helped get people there. Yet, curiously, congressional Democrats consider Ray Epps an ally, not an insurrectionist. Tonight, we can tell you that at the very least, Ray Epps lied in his sworn testimony to the January 6th committee, Epps testified that when he sent the text messages to his nephew, he he'd already left the capitol grounds to return to his hotel room. That is not true. The surveillance footage we found shows that in fact, Ray Epps remained at the capitol for at least another half an hour. You're seeing that on your screen now. What was Epps doing there? We can't say, but we do know that he lied had 2 investigators. The January 6th committee likely knew this too. Just after 2:33 PM, police officers allow 5 individuals to exit the Capitol through the Upper West Terrace doors. At 2:34 PM, a gentleman holding an American flag catches the door just as the last protester leaves. He turns to the crowd outside and waves towards the door. At the same time at 2:34 PM, a gentleman with a red cap approaches the interior doors. As the police officer notices him, he continues to approach. The police officer holds the door for the protester as he enters the capital undeterred. At 2:35 PM, a large group enters the interior of the Capitol, police standing at the doors. As a steady stream of protesters entered through the Upper West Terrace doors. They can see police officers standing at the interior doors, allowing people to pass. Around 250 protesters entered to the Upper West Terrace doors that day, many of which are charged with felony obstruction for entering a building undiscouraged. At 2:36 PM, a police officer walks towards the exit against the flow of protesters. He then turns around and begins walking with the protesters. He turned his back to them and never took a posture that was defensive or that would indicate that he feared being harmed. At 2:36:54, Speaker 1: the police allowed the crowd to pass. Speaker 0: An awful lot has happened to American society into the world over the past 3 years but for our media and political class most of it goes on mentioned because they're talking about something else they're talking about January 6th the most solemn day in American history moment worse than Pearl Harbor worse nine eleven worse than the American Civil War. That's what they're telling us. It's hard to respond to this because even now 3 years later most Americans have no real sense of what happened on January 6th and any attempts to tell them have been suppressed by the big tech companies or shouted down by NBC News and CNN and other news organizations. That's odd if you think about it. Why do most of us have no real idea what happened? There's probably no event in American history that was filmed by more people from more angles than January 6th. And yet until very recently no one had put together a timeline. What happened? People walked of them from the White House to the Capitol, some of them went inside the building and we've been talking about the aftermath. But how did all of that happen? It's on tape. Why haven't we seen it? Well, if you've watched Joe Biden recently, you know why you haven't seen it. Because January 6th is a perfect way for the Democratic Party and by the way the Republican Party for the party that controls this country, the Uniparty, to get what it wants, to suppress the population, to keep Donald Trump from running for president again, and to put its enemies in jail. Just the other day, Joe Biden often derided as senile. Didn't seem senile at all as he gave a speech about January 6th. He seemed like a fascist. Watch this. Watch Joe Biden celebrate the fact that his political opponents were sent to prison and listen as the crowd applauds him bragging about how these Trump voters are rotting in prison. Why? Speaker 1: Since that day, more than 1200 people have been charged for their assault on the Capitol. Nearly 900 of them have been convicted or plead guilty. Collectively to date, they have been sentenced to more than 840 years in prison. What's Trump done? Instead of calling him criminals, he's called these these insurrectionists Patriots. Speaker 0: He's a vicious and cruel and hollow man and really gets the for any of that but it was on display in that speech is on display all around us and the only reason they get away with it is because again most of us have no real idea what actually happened on January 6th, but it is knowable because it was filmed from thousands of angles and that tape still exists to some extent it's still being suppressed by the Republican Speaker of the House by the way who could release it but hasn't memo to the Speaker go ahead and release that video but there's still enough in the public domain that a group filmmakers decided to put it all together. Now there's very little editorial commentary in their new documentary it's called January 6th a true timeline and it should be the most famous film in the United States but it's not we're hoping that changes soon the movie lays out the day's events moment by moment it shows you what actually happened at the Capitol from video that they did not shoot but collected once again from the public domain in some cases is from liberal journalists who are on the scene. And they discovered a lot. For example at 224 while crowds outside the capital were still going growing the president then president president Trump tweeted this the USA demands the truth that's a very famous tweet the January 6th special commission, the fake committee of liars who, quote, investigated January 6th, made reference to that tweet repeatedly. They claimed it was the reason that protesters breached the capital. But that's a lie, like so much of what they said. Video from that day collected in this documentary tells a very different story. At the moment that Trump tweeted that, Metro police law enforcement on the scene appeared to have accidentally tear gas themselves and run away from the scene that's what the video shows and that left a path to the capital wide open but assess for yourself here's the video Speaker 2: Our investigation found that immediately after the president's 2:24 PM tweet, the crowds both outside the capital And inside the capital surged. Speaker 3: What the January 6th committee failed to mention was that it was officers misusing and CS gas at that same time that led to a surge. Speaker 4: Hey, Rich. Put it up the step. Speaker 3: DC MPD officer, Cowry, at the urging of officer Thao, misfires a CS gas canister that eventually forces police to fall back and lose their position. As officers on the West Plaza, unequipped with gas masks, Struggle breathing. The plume of CS gas can be seen from the overhead camera on the lower right corner of your screen. It blows over the entire area of the West Plaza that the police had secured for nearly an hour. Within 3 minutes of the officer CS gas misfire, the police line on the West Plaza entirely collapses. Speaker 0: So we now know that there were more than 200 plainclothes federal informants in the crowd. Some of them were already inside the capital before it was breached before law enforcement opened the doors for the protesters in some cases they were already inside so you can draw your own conclusions from that. But we also know that a lot of law enforcement on the ground, those were local DC cops, Metropolitan PD you'd saw on that tape, and some of the Capitol Police had nothing to do with any kind of setup. In fact, they were the victims of it. As you could see in that clip, law enforcement on the scene were completely overwhelmed and the body Kim, video shot throughout the day shows that. You see cops repeatedly telling each other that leadership has failed them and that's true. And that they've been quote, set up. Watch this. Speaker 3: At 2:33 PM, a frustrated police officer can be heard venting about being, In his words, set up. Speaker 4: They set up up. That's what they did. They set up they set up 64. Absolutely. And then they asked No. For 2 hours later, they set us up. They needed everybody by the way. No. By the way, they set us for pizza. No. We ain't got it. We're doing we put away here with some Speaker 3: At the same time, police officers discuss being unprepared for what they encountered. Speaker 4: I didn't know we are coming up for this. I wanna make sure we all had our I didn't realize how bad I they set us up to fail. Hey, Dave. There was no way we were winning that. And you've now you got at least 4 platoons that are just gassed out? Yeah. Literally. Because us, 54 doesn't have masks. Yeah. But, of course, the tape shows just the opposite as does this documentary. When Metro PD made their way to the senate floor and asked Chansley to leave, Chansley complied immediately. Speaker 0: Hey, Brandon. I'm gonna start with you. So you didn't even go into the capital that day. You've been facing prosecution. Your probation, it's about to end. What's it been like for you, and and how do you feel now? Speaker 1: I mean, it's almost impossible to sum up. So, yeah, I was a scheduled speaker at a permitted event on Capitol grounds on January 6th and when I was arriving to do my speaking engagement I started getting text messages saying we're hearing that something's happening at the building people are going inside. So I walked up to the building on the east side what's really relevant about my case is that there were 0 police officers on the east side of the building when I was there, not one. There were open barricades. There were no signs telling people they weren't allowed to be there, and I literally walked into a crowd of 100 of people. And at that moment, that is when according to the DOJ, I committed my first felony. Felony? Felony. Speaker 0: Because you engaged in a protest. Speaker 1: They said that I was standing on restricted grounds. Okay. And they gave me a felony charge for that. I shot a video outside the building for 8 minutes and I uploaded that video to Twitter and two and a half weeks later the FBI raided my house, put me in handcuffs and took me to jail. I sat in jail for several days before I found out that I was facing multiple felonies for shooting that video outside of the capitol and a misdemeanor charge. So this is what they're doing to people. They're overcharging them. They're putting them in this horrifying position where it's you against the federal government in the district of DC and you can either go to trial and they'll get a 100% conviction rate. That's what the government's gotten so far. Mhmm. Or you can take their plea deal. And when you take their plea deal, they write your confession. They say what you did. Mhmm. Speaker 0: And who is the house sergeant in arms, leading up to and on January 6? That would be Paul Irving. And the the house sergeant at arms is appointed by who? Speaker 1: He's appointed, that at that time by speaker Pelosi. Speaker 0: And in your transcribed interview, you mentioned that when you brought up the National Guard to the house sergeant at arms in the days leading up to January 6, that mister Irving said he, quote, didn't like the optics, end quote. Can you explain that discrepancy? Speaker 1: Yeah. That is that that is correct. I spoke to speaker Pelosi three times that that evening, and she went on national TV and said I'd never spoken to her. But I spoke to her three times. The three three times were the time when I went over to brief president vice president Pence at the secure location, I'd called house sergeant Arms Irving, told him I was going over to brief the vice president. I was also going over to do a personal assessment of the capital. At that point, things were getting under control. Went over there, briefed him on when we can get them back into chambers with, you know, mister Irving being fully aware. He said he wanted to get speaker Pelosi on the phone. He made a phone call from his cell phone at approximately 05:34 where I briefed speaker Pelosi. The call was when I left that location. As I was walking away, met up with mister Stenger, and we started walking over to the senate to go brief the senate when Jennifer Hemingway, I believe it was Jennifer Hemingway, handed me the cell phone, and it was Emily Barrett's cell phone calling her and it was Speaker Pelosi on the other line. This is my call with Speaker Pelosi questioning the information I'd given to Vice President Pence about when we can get back into chambers. I assured her that information was correct. I could get them back into chambers by seven 7PM, and the call ended. That was call number two. Call number three was 06:25PM. I was over at the senate from the secure location I mean, from where the senate had been sequestered. And on a cell phone using Robert Carham's cell phone, they dialed leadership who was over off-site at a secure location, and I briefed all of the leadership of the plans to get them back into chambers. That would've been call number three with speaker Pelosi. Speaker 0: You didn't have one call. You didn't have two call. You had three calls. So speaker Pelosi's comments that she didn't speak to you are inaccurate. Speaker 1: That is correct, sir. Speaker 2: Chief Sun, you previously testified on 01/03/2020 or on that on 01/03/2021, three days before January 6, you met separately with house sergeant at arms Paul Irving and senate sergeant at arms Michael Stenger. And, you asked them to approve a request for National Guard assistance on the sixth. Now this is on January. I believe this was in your book that you, met with both, Stenger and Irvin and requested National Guard assistance on to be ready on the sixth. Can you explain what happened in those two meetings with Irving and Stenger? Speaker 1: Absolutely. So on the morning of the third at 09:24AM, I specifically went to see him because I know what what a big deal it is to have National Guard come and assist us on the on the hill. I went into his office again 09:24 in the morning, went up, and immediately went up and said, hey. I'd like to bring in the National Guard to support me on to assist me on the perimeter. Because when we have a joint session of congress, it takes a lot of my personnel inside. But immediately, as soon as I asked him, his response was, I don't know. I don't like the optics of that. And his response was, besides, the intelligence doesn't support it. He he immediately then we began talking. He said, have you reached out to Mike Stenger on this? I said, no, I have not talked to him about it yet. He said, why don't you talk to Stenger and see what he has to say? So then I left, went over to Mike Stenger's office at 09:35 in the morning, walked into his office. He wasn't there. I came back. He showed up at 11:13. I showed back up at 11:53 and went in to immediately ask him, can I I'd like to request the National Guard? He said, you know, let's come up with another idea. Why don't you call do you know somebody at the National Guard? I said, yes, sir. I know General William Walker. He said, why don't you call Walker and see if we need them, how quickly could they be get here and how many people could they send us? So I called William Walker, 06:14PM that night. He told me they have a 125 people assisting with COVID response. He could reallocate those fairly quickly once he got secretary of defense approval and send them over. Speaker 2: K. When when you met with Stenger, had Irvin given him heads up that you were coming to ask for National Guard? Speaker 1: Yeah. Later on, after after January 6, specifically on April 8, I went and had lunch with Mike Stenger. And I asked him because it was kinda unusual. He came up with that idea so quickly when I went walking in. And I asked him, I said, mister Stenger, you came up with that response fairly quickly for me to call general Walker. And he had told me Paul Irving had called him ahead of time and said, son came here looking for the national asking for the National Guard. We gotta come up with another plan. Pelosi will never go for it. I was floored by him saying that. Speaker 2: Okay. So but you don't know I know this word optics had come up several times in the past or in in different contexts. Do you know if Irvin had discussed that with Stenger of what a possible response would be? Speaker 1: I have no idea, sir. Speaker 2: Alright. Around 2PM on January 6, you joined a call with Metropolitan Police Department chief Conte and National Guard representatives. According to chief Conte's transcribed testimony given to the select committee, you asked the National Guard to send assistance on that call, and he didn't hear the military people respond to your plea. Is that what you remember? Speaker 1: No. He heard clearly the military respond to my plea and say they recommended against my request for the National Guard. Robert Conte immediately butted in and said, let me get this right. You're denying the chief of the Capitol Police? And, again, he just you know, I can go farther into that if you want. Speaker 2: Okay. Thank you. Are you familiar with the term data miner? Speaker 1: I I have become, familiar with it. Yes. Speaker 2: Yeah. And according to a book by Carol Linning, general Milley was using this tool and reached out to senator Angus King warning him about violent rhetoric for January 6. Some of the intelligence included references to smuggling guns and other weapons into DC. One message said, let's burn senator McConnell's house down while he's in it. Another one seemingly addressed to members who supported certifying the election said, we're coming to kill you. Just wait a few days. Did General Milley ever reach out to you and share these concerns with you of any of this of this intelligence? Speaker 1: No, sir. Speaker 2: Do you know if he reached out to either of the sergeant at arms? Speaker 1: I have no idea, sir. Speaker 2: Would this intelligence have helped, the Capitol Police prepare for January 6? Absolutely. Speaker 3: At 01:30PM on January 6, we watched as the Metropolitan Police De began to employ officers to support the Capitol Police In doing so, the officers began to withdraw from the traffic control points that were jointly manned with District Of Columbia guardsmen At 01:49PM, I received a frantic call from then chief of United States Capitol Police Steven Sun where he informed me that the security perimeter of The United States Capitol had been breached by hostile rioters. Chief Sun, his voice cracking with emotion, indicated that there was a dire emergency at the capital and he requested the immediate assistance of as many available national guardsmen that I could muster. Immediately after that +1 30 +1 49 call, I alerted the US Army senior leadership of the request. The approval for chief Sun's request would eventually come from the acting secretary of defense and be relayed to me by army senior leaders at 05:08PM, about three hours and nineteen minutes later. I had already had guardsmen on buses at the armory ready to move to the capital.
